<br />A RESOLUTION OBJECTING TO THE TRANSFER OF OWNERSHIP OF
<br />THE LIQUOR PERMIT AT 29047 LORAIN ROAD, NORTH OLMSTED,
<br />OHIO, FROM TRIMUS LLC, DBA "KROBAR ", TO MARK HAMMOND
<br />ENTERPRISES, INC., REQUESTING A HEARING BEFORE THE
<br />DIVISION OF LIQUOR CONTROL ON THE ADVISABILITY OF
<br />TRANSFERRING SAID PERMIT, AND DECLARING AN EMERGENCY.
<br />WHEREAS, this Council received notice on or about January 10, 2006 of a proposed
<br />transfer of the liquor permit at 29047 Lorain Road, North Olmsted, Ohio, from Trimus LLC to
<br />Mark Hammond Enterprises Inc; and
<br />WHEREAS, the current permit holder operates the Krobar at said premises, a bar which
<br />is open two nights each week, including Saturday nights, when a teen dance is operated at the
<br />premises attended by children as young as 13 years of age and adults over the age of 21; and
<br />WHEREAS, according to information and documentation provided by the North Olmsted
<br />police department to this Council, the Krobar as been the scene over the course of the last two
<br />years of numerous arrests by the North Olmsted police department for violations of many State
<br />and local criminal laws, including: assault, disorderly conduct, underage possession, underage
<br />consumption, possession of marijuana, felony drug trafficking, felony vandalism, excessive
<br />noise, curfew violations, and public indecency; and
<br />WHEREAS, in the month of January 2006, the North Olmsted police, responding to calls
<br />at the Krobar, made 23 arrests on the teen dance nights; and
<br />WHEREAS, this Council believes, based upon the information provided to it by the
<br />North Olmsted police department, that the holder of the liquor permit at 29047 Lorain Road has
<br />operated the liquor permit premises in a manner that demonstrates a disregard for the laws,
<br />regulations, or local ordinances (ORC Section 4303.292(A)(1)(b)); and
<br />WHEREAS, this Council further believes, based upon the information provided to it by
<br />the North Olmsted police department, that the place at 29047 Lorain Road at which the said
<br />liquor permit is held, is so located with respect to the neighborhood that substantial interference
<br />with public decency, sobriety, peace, or good order would result from the transfer of ownership
<br />of the permit and operations under it by the applicant (ORC Section 4303.292(A)(2)(c)); and
<br />WHEREAS, based upon the foregoing and the recommendation of the North Olmsted
<br />police department, this Council believes it is in the best interests of the public health, safety and
<br />welfare of the North Olmsted community to object to the said transfer of ownership of the liquor
<br />permit at 29047 Lorain Road and request a hearing before the Division of Liquor Control, in
<br />accordance with the provisions of ORC Section 4303.26, on the advisability of said transfer of
<br />ownership of liquor permit;
