__ ~,,.~.v~_,,. __ _ .x,.:,,... <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0.2006 -1 <br />BY: Council Members Gareau and Miller <br />~u~,ec~ `S~a/o 6 <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO <br />THE ELECTORS OF THE CITY OF NORTH OLMSTED OF <br />AN AMENDMENT TO ARTICLE Ii; SECTION 9 OF THE <br />CHARTER OF THE CITY OF NORTH OLMSTED TO <br />ELIMINATE THE REQUIREMENT THAT COUNCIL VOTE <br />ONL Y B Y ROLL CALL, THEREB Y ENABLING COUNCIL TO <br />PROVIDE BY R ULE FOR OTHER A UTHORIZED METHODS <br />OF VOTING UPON THE ISSUES THAT COME BEFORE IT, <br />AND DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, Article IV, Section 9 of the Charter provides that all votes of Council on <br />every issue before Council must be taken by roll call; and <br />WHEREAS, the voting method of roll call is lengthy and oftentimes unnecessarily time <br />consuming; and <br />WHEREAS, it is the desire of this Council to submit to the voters of North Olmsted a <br />proposal to amend Article IV, Section 9 of the Charter of the City of North Olmsted so as to <br />eliminate the requirement that all Council votes be by roll call, and require instead that only the <br />final vote on ordinances and resolutions be by roll call, thereby enabling Council to provide by <br />rule for other authorized methods of voting upon all other issues before it; and <br />WHEREAS, this proposal was submitted by this Council to the Charter Review <br />Commission for review and recommendation in accordance with Article XIV, Section (b)(2) of <br />the City Charter, and, within 60 days of the date of referral, the Commission on the 27th day of <br />January, 2006, filed a written report with the Clerk of Council in which the Commission <br />recommended, by a unanimous vote, that the legislation be amended to substitute the following <br />proposed new language as the new first paragraph of Article IV, Section 9 of the Charter: <br />"Council shall adopt it own rules, regulations or by-laws and shall keep a journal of alp its <br />proceedings. The journal shall be open for public inspection at all reasonable times. The final <br />vote upon any Ordinance or Resolution shall be by roll call and the vote of each Councilman <br />shall be entered upon the journal;" and <br />WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner <br />than 120 days, and no later than 60 days, prior to the date of the election at which the issue will <br />be voted upon by the electorate; <br />
