~:~.. <br />_. <br />CITY OF NORTH OLMSTED <br />RESOLUTION N0. 77 - 9 <br />BY : Gi . <br />A RESOLUTION TO THE UNITED STATES POSTAL <br />SERVICE REQUESTING DOOR-TO-DOOR DELIVERY <br />IN NEW SUBDIVISIONS WITHIN THE CITY OF <br />NORTH OLMSTED AND DECLARING AN EP4ERGENCY. <br />WHEREAS, this Council has in its possession a communication <br />from the United States Postal Service to Area Managers entitled <br />"Extension of Delivery - Form 697", and, <br />WHEREAS, Form 697 states that door-to-door delivery will <br />not be established or extended where average lot widths exceed <br />50 Ft. or the average set-back exceeds 30 Ft, from the carrier's <br />line of travel and that under such circumstances, delivery will <br />be made to curb-line boxes only, and <br />WHEREAS, the Zoning Code of the City of North Olmsted <br />provided for the establishment of minimum lot width requirements <br />for single family dwellings of between 60 Ft, and 80 Ft, and <br />WHEREAS, the minimum set-back requirements, as imposed by <br />the Zoning Code is 50 Ft., and <br />WHEREAS, requirements imposed by the United States Postal <br />Service of door-to-door delivery only to new residences having a <br />maximum 50 Ft. width and a 35 Ft, set-back is an arbitrary <br />classification and a denial of equal protection under the law <br />in that it places a requirement upon new residences which is not <br />required upon presently existing residences, and <br />WHEREAS, this Council believes that all citizens, whether <br />established or prospective residents of the City of North Olmsted, <br />should be treated by all branches of Government, Federal, State <br />or Local, in such a way as to be treated equally and be guaranteed <br />equal protection as a class under the law, and <br />WHEREAS, this Council, on behalf of itself, the Administration, <br />and more particularly, the residents of new Subdivisions and residents <br />of prospective Subdivisions whose minimum lot requirements are not in <br />compliance with the directive of the United States Postal Service, <br />vehemently objects to Form 697 and requests that the regulation be <br />reconsidered and repealed. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council, on behalf of the residents of <br />the C1 y o orth Olmsted, both present and prospective, and on <br />behalf of itself and the Administration of the City of North Olmsted, <br />does hereby and object to "Extensions of Delivery - Form. 697" of the <br />United States Postal Service promulgated by the U. S. Postal Service, <br />Cleveland, Ohio, 44101 under date of September 16, 1975 on the basis <br />that such directive is a denial of equal protection in violation of <br />the Fifth and Fourteenth Amendments of the Constitution of the <br />United States <br /> <br />
