<br />A RESOLUTION URGING THE OHIO DEPARTMENT OF TRANSPORTA-
<br />TION TO RECONSIDER ITS DECISION TO ELIMINATE NOISE BAR-
<br />RIERS IN LOCATION #13 FROM FITCH ROAD 1,650 FEET WEST
<br />ON THE NORTH SIDE OF I-480 AND ALSO ON THE SOUTH SIDE,
<br />AND DECLARING AN EMERGENCY.
<br />WHEREAS, in early 1978, Thomas M. Krall, Deputy Director of
<br />the Ohio Department of Transportation, District Twelve, verbally
<br />committed the Ohio Department of Transportation to installation
<br />of noise barriers in I-480 Location #13, and
<br />WHEREAS, on April 14, 1978, Mr. Krall and staff scheduled and
<br />conducted a meeting in North Olmsted Town Hall with affected resi-
<br />dents from I-480 Location #13, at which noise impact and types of
<br />available noise barriers were preser_ted ta residents, with the
<br />clear intention on the part of the Ohio Department of Transporta-
<br />tion that these subject areas were being presented because noise
<br />barriers would definitely be installed, and
<br />WHEREAS, the public meeting on April 14, 1978, was concluded
<br />by distribution of a survey sheet supplied by the Ohio Department
<br />of Transportation, on which affected residents indicated whether
<br />they desired noise walls and which types they preferred, leaving
<br />orily the question of which type of noise wall would be erected,
<br />not any question as to whether the noise walls would be erected,
<br />and
<br />WHEREAS, on December 3, 1979, the Mayor received a telephone
<br />call from Arthur Haddad, Assistant Director of the Ohio Department
<br />of Transportation, informing him that the noise barriers previously
<br />committed for I-480 Location #13 would not in fact be installed,
<br />This telephone call came as a result of a meeting in Columbus on
<br />November 14, 1979, between Mr. Haddad, the Mayor, the City Engineer
<br />and State Representative Rocco Colonna, as a result of the Mayor's
<br />request to discuss the elimination of noise barriers for I-480
<br />Location #13, and
<br />WHEREAS, the City of North Olmsted has conducted itself in a
<br />spirit of cooperation and in good faith during this major trans-
<br />portation project, as have the residents of the City of North
<br />Olmsted, despite the disruptive environmental effects of said
<br />project, and
<br />WHEREAS, the Council of the City of No'rth Olmsted considers
<br />this reversal of an original commitment to be detrimental to the
<br />safety, health and welfare of the affected residents and an un-
<br />conscionable decision without merit or justification.
<br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
<br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO:
<br />SECTION 1; That this Council daes hereby urge the Qhio Depaxt-
<br />ment of Transportation to reconsider its decision and reinstate its
