? . <br />CITY OF NORTH 0114STED <br />ORDINANCE N0. 79- 83 <br />A <br />BY: <br />' <br /> <br />AN ORDINANCE ANLFNDING PART SFVEN OF THF CODIFIED ORDINANCES <br />OF 'IT-F CITY OF NORTH OLAI.STED BY ADDINC, NFW CHAP'I'ER 749 <br />EIV'_T'TTLED "MASSAGE PARLORS", AND DF,CLARING AN E?IERGENCY. <br />?Nf-IERF.AS, the Council of the City of North Olmsted has determined that the <br />current North Olmsted Codified Ordinances fail to provide for the regulation <br />of massage parlors and other establishments offering massages, and <br />WfIEREAS, the Council for the City of North Olmsted deems it necessary to <br />Drovide such regulation for the health, safety and welfare of the citizens of <br />the City of North Olmsted. <br />NOW, T'HEREFO.RE, BE IT ORDAINED BY THE COUNCIL OF T'HE CITY OF NORTH OLNtSTF,D, <br />COUNr!'Y OF GUYAHOC,A AND STATE OF OHIO: <br />SECTION 1: That Part Seven (Business Regulation Code) of the North Olmsted <br />Codi ie Qr inances be amended by adding new C'hapter 749 as follows: <br />749.01 DEFINITIQNS. <br />(a) Employee. Any person over eighteen (18) years of age, <br />other than a massagist, who renders any service in connection with <br />the operation of a massage business and receives comnensation from <br />the operator of the business or natrons. <br />(b) Licensee. The person to whom a license ha.s been issued to <br />who owns or operates a massage establishment as defined herein. <br />(c) r9assage. Any method of pressure or friction against or <br />stroking, lmeading, rubbing, tapping, pounding, vibrating, or ' <br />stimulating of the external parts of the hwnan body with the <br />hands or with the aid of any mechanical electrical annaratus or <br />apnliances with or without such sulnplementary aicis a.s rubbing <br />alcohol, liniments, antiseptics, oi1s, powder, creams, lotions, <br />ointment or other such similar preparations conmionly used in the <br />?oractice of massage, under such circwnstances that it is reasonably <br />expected that the person to whom the treatment is provided or some <br />third nerson on his or her beha.lf will pa,v m.oney or give any other <br />consideration or any gratuity therefor. <br />(d) Massage Establishment. Any establishment having a source <br />of income or compensation derived from the practice of massage as <br />defined in 749.01(c), and which has a fixed place of business where <br />any person, firm, association, or coiToration engages in or carries <br />on any of the activities as defined in 749.01(b). <br />(e) Ma.ssagist, Masseur or Masseuse. Any person who, for any <br />consideration whatsoever engages in the practice of massage as <br />defined in 749.01(C). <br />(f) Outcall Massage Service. Any business, the fLmction of which <br />is to engage in, or carry on massages at a location designated by the <br />customer or client rather than at a massage establishment as defined <br />in 749.01(d). <br />(g) Patron. Any person eighteen (18) years of age who receives <br />a massage tmder such circtunstances that it is reasonably exnected <br />that he or she will nay money or give any other consideration therefor.
