~' <br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 76 - ,C/,2j <br />AN ORDINANCE ACCEPTING EASEMENTS FOR THE INSTALLATION <br />AND MAINTENANCE OF A WATER MAIN FOR THE PURPOSE OF <br />SUPPLYING WATER SERVICE BY THE CITY OF CLEVELAND TO <br />CITY LINE ESTATES SUBDIVISION <br />WHEREAS, Marie P. Benuska and D. J. Caldwell Realty, Inc. <br />have presented to the City of North Olmsted evidence of some <br />ownership interest in the City Line Estates Subdivision, and <br />WHEREAS, Marie P. Benuska and D. J. Caldwell Realty, Inc. <br />desire to extend water mains to service City Line Estates <br />Subdivision, and <br />WHEREAS, the City of Cleveland requires that extensions of <br />water lines shall only be approved if easements are granted to both the <br />City of Cleveland the City of North Olmsted so that water mains may <br />be constructed and maintained therein, and <br />WHEREAS, this Council deems it in the best interest of the <br />City of North Olmsted to accept the easements described herein. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That this Council does hereby accept easements <br />from Marie P. Benuska and D. J. Caldwell Realty, Inc. for the <br />installation and maintenance of a water main for the purpose of <br />supplying water service by the City of Cleveland into City Line <br />Estates Subdivision, a copy of said easements being attached <br />hereto, marked Exhibit A and made a part hereof as though fully <br />rewritten herein. <br />SECTION 2: That the Director of Finance is hereby authorized <br />to issue his warrant and pay to Marie P. Benuska and D. J. Caldwell <br />Realty, Inc. One Dollar and other valuable consideration for the <br />granting of easements. <br />SECTION 3: The Engineer of the City of North Olmsted is <br />hereby directed to cause said easements to be recorded in the <br />office of the County Recorder. <br />SECTION 4: That the Clerk of this Council is hereby authorized <br />to forward a certified copy of this ordinance to the Director of <br />Public Utilities of the City of Cleveland. <br />SECTION 5: That this ordinance shall take effect and be in <br />force from and after the earliest period allowed by law. <br />NORA T. <br />APPROVED: <br /> <br /> <br /> <br />PASSED <br />ATTEST: <br />
