CITY OF NORT~t OLMSTED ORDINANCE N0. 74 - 128 BY: RON WILAMOSRY AN ORDINANCE AMENDING SECTION 1173.02 ENTITLED "PERMITTED BUILDINGS AND USES" OF CHAPTER 1173 ENTITLED "GENERAL RETAIL BUSINESS DISTRICT" OF THE ZONING ORDINANCES OF THE CITY OF NORTH OLM5TED, AS AMENDED. WHEREAS, this Council has recommended that Section 1173.02 be amended for the purpose of including within said section the requirement that all auto washes be required to have emergency access driveways, and WHEREAS, the Planning Commission of the City reviewed said proposal at their meeting of July 23, 1974, and requested legislation for their review and approval; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA ANDS STATE OF OHIO: SECTION 1: That Section 1173.02 entitled "Permitted Buildings and Uses of Chapter 1173 entitled "General Retail Business District" of the Zoning Ordinances of the City of North Olmsted be and the same is hereby amended, and as amended shall read as follows: "1173.02 Permitted Buildi:nas and Uses In a General Retail Business District. land may be used and buildings or structures may be designed, built, altered or used only for one or more of the following permitted uses: A. Any use permitted in the least restrictive Residence District adjacent to any part of such General Retail Business District but subject to the conditions therein set forth. B. Any use permitted in paragraphs (B), (C), (D), (E) and (F) of Section 1171.02. C. Retail business engaged in: 1. The sale of food and beverages of all kinds including sale for consumption on the premises, provided, however, no establishment engaged in the business of selling spiritous, vinous or malt beverages for consumption on the premises shall be located nearer than five hundred (500) feet from the lot occupied by an existing church, public or private school, playground, park, library or .public building. 2. The retail sale of general merchandise including sales in a department store. 3. The retail sale of apparel of all kinds. 4.
