<br />CITY OF NORT~t OLMSTED <br />ORDINANCE N0. 74 - 128 <br />BY: RON WILAMOSRY <br />AN ORDINANCE AMENDING SECTION 1173.02 <br />ENTITLED "PERMITTED BUILDINGS AND USES" <br />OF CHAPTER 1173 ENTITLED "GENERAL RETAIL <br />BUSINESS DISTRICT" OF THE ZONING ORDINANCES <br />OF THE CITY OF NORTH OLM5TED, AS AMENDED. <br />WHEREAS, this Council has recommended that Section 1173.02 <br />be amended for the purpose of including within said section the <br />requirement that all auto washes be required to have emergency access <br />driveways, and <br />WHEREAS, the Planning Commission of the City reviewed said <br />proposal at their meeting of July 23, 1974, and requested legislation <br />for their review and approval; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA ANDS STATE OF OHIO: <br />SECTION 1: That Section 1173.02 entitled "Permitted <br />Buildings and Uses of Chapter 1173 entitled "General Retail Business <br />District" of the Zoning Ordinances of the City of North Olmsted be and <br />the same is hereby amended, and as amended shall read as follows: <br />"1173.02 Permitted Buildi:nas and Uses <br />In a General Retail Business District. land may be used and buildings <br />or structures may be designed, built, altered or used only for one <br />or more of the following permitted uses: <br />A. Any use permitted in the least restrictive Residence District <br />adjacent to any part of such General Retail Business District <br />but subject to the conditions therein set forth. <br />B. Any use permitted in paragraphs (B), (C), (D), (E) and (F) of <br />Section 1171.02. <br />C. Retail business engaged in: <br />1. The sale of food and beverages of all kinds including sale <br />for consumption on the premises, provided, however, no <br />establishment engaged in the business of selling spiritous, <br />vinous or malt beverages for consumption on the premises <br />shall be located nearer than five hundred (500) feet from <br />the lot occupied by an existing church, public or private <br />school, playground, park, library or .public building. <br />2. The retail sale of general merchandise including sales in <br />a department store. <br />3. The retail sale of apparel of all kinds. <br />4. The retail sale of furniture, china, floor coverings and <br />household goods. <br />5.
