MINUTES OF THE MEETING OF THE COUNCIL

<br />AUGUST 15, 1961 - 8:15 P,M,
<br />Present were Paul J, Gareau, Mayor; Francis J, O~Neilh President of Council Pro Tem;
<br />Ralph Christman, Dewey Limpert~ A.L, Mang ani~ Lillian Nicholas, George Porter,
<br />Also present were Lloyd E, Barnes Service Director; C,J, Ovi att, Solicitor; Alex
<br />Kanareff~ Engineer; WoL, Gerlach Finance Director; and Louise Hal h Clerk,
<br />Absents Bruce MacDonald, President of Council; Henry Caster, J,T, Wilson Safety
<br />Director.
<br />The minutes of the regular meeting of August 1~ 1961 were approved as corrected,
<br />The minutes of the adjourned meetings of August 2~ and August 3, 1961 were approved
<br />as written.
<br />Mr. Christman moved seconded by Mrs, Nicholas, that the Clerk be directed to
<br />advise E. Gundy~ Building Cosarnissioner, that when there is a 5" service line in
<br />an existing sewer service lines Council approved the use of the 5a line ~~Qthh~~~~' than re•

<br />The Mayor gave the July reports for the Eire Department and Building Department in
<br />the absence of the Safety Director,
<br />The Mayor presented a resolution adopted by the Ex~tive Board of the American
<br />Legion recommending all citizens display the flag every day amd that the slogan
<br />"Everyone fly the American Flag daily" be adopted and requested that Council
<br />consider passing such a resolution,
<br />The Mayor read a communicati on regarding the proposed rate increase by the East
<br />Ohio Gas Ccxnpany.
<br />The Mayor stated that Council could not direct the holding up of Building
<br />permits in a subdivision as this is illegal unless there is a violation of
<br />a City Ordinance or the Building Code,
<br />Mr, J, J, Javurek, 27181 Pompton Dr.~ asked when Pompton Dr, would be dedicated,
<br />He was advised that the street could not be dedicated until all the work is
<br />completed, He was also advised by Mr, OtNeill that Council as a Legislative Body
<br />ca~1.d not enter into the disagreement between Mr, Javurek and Mr, Bauer that this
<br />is a personal prob~m.
<br />The Mayor advised that a suit has been filed against the City by the Uncle Marty
<br />Ice Cream Co, and that the hearing is to be August 22~ 1961 at 11:00 A.M,

<br />The Clerk read a communication from Floyd G. Browne and Associates to/Mayor
<br />relative to Ordinaric a Na, 61.•7.2x.3.
<br />Mr, Oviatt advised that he had cleared up the misunderstanding concerning Ordinance
<br />61-1lt3 with Floyd G, Browne and Associates,
<br />The Clerk read a communication from Carl DiFranco & Son, Inc, in regards to th e
<br />cleaning or ins tallati on of septic tanks,
<br />~- The Clerk read a communication from Floyd. G. Browne and Associates to Mr,
<br />Ralph Christman referring to the sewer rental charge.
<br />Mrs. Nicholas moved, seconded by Mr. Mangani! that the Solicitor be directed to
<br />prepare legislation requesting citizens to display the flag every day and that
<br />the slogan "Everyone fly the American Flag daily" be adopted. "Yeas~~ Christman}

<br />The Streets, Sidewalks Sewers and Ditches Committee is to study the difficulties
<br />encountered by the Service Director in obtaining right~•of=way~..on undeveloped
<br />properties. Property owners are requesting e~cclusion of tap-in charges, area
<br />charges, etc„ in exchange for Bight-of•-why,
<br />Mr, Christman moved seconded by Mr, Limpert~ that the sewer service line be
<br />installed by the City for Mr. Leroy Harris because Mr, Harris has deeded property
<br />to the City for the Pumping Station, "Yeas« C}u~t~ttnan, Lampert, Mangani, Nicholas,
<br />O~Neill, Par~ter.

<br />of Article IX of the Charter of the City of North Olmsted had been submitted.
