MINUTES OF A MEETING OF THE COUNCIL
<br />OF THE CITY OF NORTH OLMSTED, OHIO
<br />AUGUST 18, 1959 - 8:15 P.M.
<br />Present were Paul J. Gareau, Mayor; Ralph A. Hazelton, President of
<br />Council; Eddie Hixson, Wm. H. Kramer, Mary Alice i~ynen, Bruce i~acBozl~,lu,
<br />Francis J. O'Neill and James T. Wilson.
<br />Also present were Lloyd E. Barnes, Service Director; C. J. Oviatt,
<br />Solicitor; Alex Kanareff, Engineer; and E. M. Christman, Clerk.
<br />Absent: Thomas J. Raleigh, Safety Director; Evelyn Hinkel and Alice
<br />Dobbins Rhine, Treasurer.
<br />The minutes of the regular meeting of Council, August 4th, were approved
<br />as read,
<br />The Mayor reported an injunction had been received from the Cuyahoga
<br />County Common Pleas Court, which by action of Council should be referred
<br />to the Solicitor.
<br />The Clerk read a communication from the Safety Director, addressed to
<br />Mrs. Hinkel, advising action necessary relative to the open body of water
<br />located West of Charles Avenue. He also read the communication, addressed
<br />to the Zehman-Wolf & Sherman Construction Company, directing them to comply
<br />with previous requests to fill the pond.
<br />Mr. Kramer is now present.
<br />Discussion ensued relative to the ordinance now in effect pertaining to
<br />bodies of water, and the Solicitor stated it would be a matter for the
<br />prosecutor. He had been in contact with Mr. Kinchen and Mr. Weisman and
<br />was advised they would take care of the matter, if liable, under the Engineer's
<br />supervision, and recommended Council pass a resolution giving the developers
<br />a time limit in which to correct the situation. The Building Commissioner
<br />had also contacted the developers by letter and they denied ownership. The
<br />Engineer had made a survey and it was determined it was located on the Zehman-
<br />Wolf-Sherman property. The Engineer's expense for the survey should be de-
<br />fra~red by the developers.
<br />It was moved by Mr. O'Neill, seconded by Mr. Wilson, the Solicitor prepare
<br />the necessary legislation to direct the owners of the property to remove
<br />the pond on the property located at Nest 308th and North Gourt, by the
<br />31st of August, 1959. "Yeas" Hixson, Kramer, Lynch, MacDonald, O'Neill, Wilson.
<br />To be included in the resolution should be the amount of the Engineer's
<br />expense. The Solicitor will have the resolution prepared for the next
<br />meeting of Council.
<br />In regards to the injjunction pertaining to the She11 Oil Gasoline Station
<br />at Columbia and Lorain Roads, it was moved by Mr. O'Neill, seconded by Mr.
<br />MacDonald, the Solicitor be directed to defend the City in this action. "Yeas"
<br />Hixson, Kramer, Lynch, MacDonald, O'Neill. "Nay" Wilson.
<br />`1'b_e Service Director reported the contract fox the paving of Columbia Road was
<br />awarded by the State to the Schloss Paving Company, at a total cost of
<br />X38,059.20• Twenty percent of the total cost is the City's share. No
<br />starting date was indicated.
<br />The Director also reported he had been requested to make an inspection of
<br />the Georgette Storm Sewer. In a report from the Street Commissioner, this
<br />was accomplished and was checked from the beginning to the Big Inch and
<br />it was found that the sewer was clear.
<br />The Director also reported bids for the service garage were opened on
<br />Saturday. Bids varied from X8,641.00 to $15,695.00 and the Board of Control
<br />awarded the bid to the Sepper Corporation at X8,641.00 and asked Councils
<br />approval of same.
