O'Neill, Cauncilmen Caster, Hodgins, <br />Limpert, Prokasy, West, <br />Absent: Councilmen Eian and Miller. <br />Also present: Mayor Ralph E. Christman, Service Director Charles Watts, <br />Finance Director William Gerlach, Acting City Engineer Karhan, <br />Law Director J. Bruce Kitchen, Clerk of Council Florence Ho1m. <br />Minutes of ineeting of October 21st were approved as written. <br />Mayor Christman stated that at the October 21st meeting tie had been requested <br />to ascertain cost of a feasibility study making use of retention basins ts? <br />help alleviate floading i7z NUrch Olmsted. Discussion wlth rlayd Browrie engir- <br />eer indicated it would cost between three and five thousanci dollars. The Mayor <br />then recommended that Council meet and fu.11y discuss subject with an engineer <br />from Floyd Browne, <br />Service Director Watts reported that tree planting in dedicated subdivisions <br />would take place during the next two to three weeks. Alsn, mini buses are <br />now in operatione <br />Mra Prokasy, Chairman Design & Platting Committee, said this committee had <br />met with Decker Road residents and that Design & Platting Committee recommends <br />that the administration conduct a traffic survey in the entire area before <br />the committee makes any final recommendation on the S. D, C. Subdivision. <br />Mre Prokasy also mentioned that legislation on the McCrone Subdivision had <br />been added to Agenda tonight. <br />President of Council 0'Neill read a letter from Carole J. Maroney which con- <br />tested both the candidacy of Mr. James Prokasy and the legal right to sit as <br />a member of Council for balance of his term, based on alleged fact that he <br />had not maintained a cnntinuous residency within the City of North Olmsted <br />during his term of officea Mr. 0'Neill also read the Law Director's ruling <br />on the term "residence" when used with reference to the qualifications of <br />electors, as follows: "The term "residence" when used with reference to <br />qualifications of electors is generally construed as synonymous with dnmici1. <br />The term "domicil," in a strict Iegal sense, is properly the place where a <br />person has his true, fixed, permanent home and principal establishment, and <br />to which place, whenever he is absent, he has the intention of returning, and <br />from which he has na present intenrion of moving." Mro West stated that <br />Carole J. Moroney had not submitted, nor could she provide, any actual proaf <br />of specific violation of the resident rule, and, therefore, Council had no <br />reason to take any action, since there were no facts. Mr. G'Neill said that <br />based on the Law Directar's ruling, and information obtained, Council had <br />agreed that Mr> Prokasy had in no way violated the rules set down in the <br />North Olmsted Charter, and the complaint of Carole J. Moroney was dismissedA <br />Mr. Schulz, 6725 Nancy, inquired about work being done at intersection of <br />Nancy and Angela. Mr. Karhan reported that the whole intersection will be <br />? taken care of at this time, and Service Director Watts added that it was be- <br />ing done in a manner that would enable traffic to continue through area. <br />
