.? <br />MTNUTES OF THE MEETING OF THE COUNCIL <br />OF THE CI't'Y OF NORTH OLMSTF.D <br />NOVEMBER 1, 1983 <br />Present: President James Boehmer, Councilmen Bierman, Logan, McKay, <br />Petrigac, Saringer, Wilamosky, ?aoerpel, <br />Also present: Mayor Robert Swietyniowski, Law Director Michael Gareau, Finance <br />Director Edward Boy1e, Safety Director Eugene Petre, Service <br />Director Joseph Corrigan, Clerk of Council Florence Campbell. <br />Meeting was called to order by President Boehmer at 8;05 P.M. <br />Members o£ the audience were invited to ,join Members of Council in reciting the <br />Pledge of Allegiance. <br />Minutes of the Council Meeting of October 18, 1983, were approved. <br />Before moving into regqlar business, President Boehmer announced that Ordinance <br />No. 83-126, to make and transfer appropriations, had been removed from the agenda. <br />A1so, Ordinance No. 83-131, a transfer of appropriations; Ordinance No. 83-132, <br />Parks and Recreation Department salaries; and Ordinance No. 83-133, non-uniform <br />Police personnel salaries, have been added to the agenda. <br />Mayor Swietyniawski reported; 1) Met today with Dalton, Dalton, Newport, consultant <br />on the Sewer Treatment Plant. Will be presenting three pieces of legislation with <br />respect to the grant North Olmsted is receiving; time limitations to allow for <br />advertising for bids prior to December 15th may require special council meetings. <br />Finance Director Boyle reported: 1) Will be selling the Admin Facility notes on <br />November llth, in the amount of $3,050,000.00. New rate will be 6.65%; a savings <br />of approximately $30,000 in interest over last year's issuance. <br />2) Has received the amended certificate from the County Auditor this week. <br />3) Cable Television has paid its third quarter, 1983, franchise fee of $12,695, on <br />time and under the guide lines established earlier this year. <br />4) Will be receiving the first check for revenue sharing around January lst for the <br />new entitlement period. An audit clause in the House Bill will require any City <br />receiving Federal revenue sharing to have an annual audit. <br />5) Recently passed H.B. 3525 would make employee benefits taxable. There is a non- <br />discriminatory requirement. If a benefit doesn't discriminate between jobs, that <br />will not be taxable. Since City benefits, such as Blue Cross, etc., do not dis- <br />criminate, Mr. Boyle does not f_eel this will affect City emnloyees. <br />Law Director Gareau reported: 1) Argued the Jandecka dog shooting case in the <br />Court of Appeals. One of the assignments of error raised by Law Director was that <br />in making his decision, Judge 0'Donnell fa3.led to provide findings of facts and <br />conclusions of law even though they had been requested. The Eighth Appellate <br />District Court has remanded the case back to Judge 0'Donnell, ordering him to make <br />findings of facts and conclusions of law within the next thirty aays and the court <br />will retain jurisdiction over the case. Law Director will file a motion to establish <br />a new briefing schedule so that once the findings of facts and conclusions of law <br />are received, he can raise additional assignments of error if need be.
