? <br />MINUTES OF THF MEETTNG OF THE COUNCIL <br />OF THE CITX OF NORTH OLMSTFD <br />OCTOBER 18, 1983 <br />Present: President James Boehmer, Councilmen Bierman, Logan, McKa.y, <br />Petrigac, Saringer, Wilamosky, Woerpel. <br />Also present: Ma.yor Robert Swietyniowski, Law Director Michael Gareau, Finance <br />Director Edward Boyle, Safety Director Eugene Petre, Service <br />Director Josenh Corrigan, Clerk of Council Florence Camnbell. <br />Meeting was called to order by President Boehmer at 8:00 P.M. <br />Members of the audience were invited to join Members of Counci.l in reciting the <br />Pledge of Allegiance. <br />Minutes of the Council Meeting of October 4, 1983, were approved. <br />Mayor Swietyniowski reported: 1) Has just received signed agreement f_rom the City <br />of Westlake for the installation of a traffic light on Columbia Road at the inter- <br />section of Rose Road and Fawn Drive. <br />Service Director Corrigan reported: 1) Leaf Collection Program started this cveek; <br />crews will follow the regular refuse pickup days in the various wards; two crews <br />are out since quantity of fallen leaves right now is light. Will attempt to use <br />cable TV to keep residents informed of when the crews will be in their area. <br />Finance Director Boyle reporteds 1) Has been discussing the reissuance of notes <br />covering the new administration facilities with McDonalds; issue will probahly <br />be closed later this week. <br />2) Has also been talking about the sewer grant, which involves quite a bit of financing <br />Will try to formulate a few plans to present to Council in late November, along with <br />a plan on a possible bond issue to get rid of some notes or reissuance of notes in 1984. <br />3) Finance Department and Office of Budget and Management are now located in their <br />permanent quarters on the second floor of the new administration building. <br />Law Director Gareau reported: 1) Last Thursday, received a law suit dealing with <br />former City Engineer Zurawski who claims he was entitled to Civil Service protection <br />relative to being discharged and if not, then he was entitled to removal procedures <br />by Council, as any department head would normally be. Law Director feels the Charter <br />is abundantly clear with respect to the status of the person heading the Division of <br />Engineering. Charter specifically makes that position an unclassified oosition; <br />consequently there is no Civil Service protection. T4th respect to the second allega- <br />tion, only the department head is anpointed by the Mayor and requires the removal <br />procedure of going through Council. In li?ht of existing Charter provisions, Law <br />Director is going to move to dismiss the complaint. <br />2) Wednesday morning, in the Eip,hth Appellate District Court, wi11 be arguing the <br />Jandecka appeal with respect to the dog shooting incident. Jud;e 0'Donnell, in the <br />lower court, had ruled that Patrolma.n Jandecka had a right to shoot the dog on <br />Columbia Road because there is a statute in Ohio dealing with sheep and other animals, <br />saying that if a dog worries a sheep or people, a person has the right to shoot an <br />animal of this nature. Law Director feels this does not apply and will be arguing <br />this tomorrow morning in the Court of Appeals.
