F. .> <br />MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />DECEMBER 18, 1984 <br />Present: President James Boehmer, Councilmen Bierman, O'Grady, Petri¢ac, <br />Sarinper, Tallon, ?~Jilamosky. <br />Also present: Mayor Robert Swietyniowski, Law Director Michael Gareau, Finance <br />Director Edward Boyle, Clerk of Council Florence Campbell. <br />Absent: Councilman Rademaker. <br />Meeting was called to order by President Boehmer at 8:00 P.M. <br />Members of the audience were invited to join Members of Council in reciting the <br />Pledge of Allegiance. <br />Minutes of the Council Meeting of December 4, 1984, were approved. <br />President Boehmer announced that Ordinance No. 84-126, covering Police Department <br />wages, was being added to tonight's agenda.. <br />Law Director Gareau reported: 1) Brief has been submitted to the 7th District <br />Court with respect to the Luwanna Cooper Case. Will have a copy for any Council <br />Member who requests one. <br />2) The 8th District Court of Appeals has handed down a ruling with respect to the <br />Jandecka Case dealing with the dog incident. The Court ruled in favor of Mr. <br />Jandecka stating that he had not violated any City rules with respect to his con- <br />duct; basically, because the Civil Service Commission had ruled that the first shot <br />fired was justified, then any conduct thereafter was. ,justified. Law Director <br />recommends the City not appeal the case any further. <br />3) Had a pretrial today on the Romp law suit dealing with the request to declare <br />the Zoning Ordinance, as it applies to their property, unconstitutional. Iias met <br />with Council as a Whole Committee and a number of the residents. Residents re- <br />quest a 50 foot buffer; Romp is agreeable to 35 feet; because of the 15 foot differ- <br />ence, no agreement was reached; trial date is set for May 20, 1985. <br />Finance Director Boyle reported: 1) Extra monies coming in from State Highway and <br />Street Maintenance have exceeded Mr. Boyle's anticipated revenues by $142,472. Income <br />tax collections this year should be approximately $2,970,000; $500,000 greater than <br />last year and almost $400,000 greater than budgeted for this year. This is due to <br />business doing well in North Olmsted and agressive delinquency collections. <br />2) Met with National City Bank and McDonald and Company last week. National City <br />Bank called today regarding financing and is agreeable, in principal, to doing the <br />letter of credit. It will make North Olmsted the first public utility in Ohio to <br />do all its financing locally, through an Ohio bank. Mr. Kuhn had previously advised <br />Council that a lot of other City's utilities use out-of-state and out-of-country <br />banks. The Step III renovation is coming along pretty well and Zimpro equipment <br />should be arriving. January payment will be about $1,700,000. Payments have been <br />about a half a million so this will be the biggest chunk so far. <br />3) ?aorkr~ns' Compensation rating came in. City is at 1.31% and is protesting part <br />of this. If protest is successful, the rate will go down to 1.26,°~, still one of the <br />safer cities in the state. <br />
