<br />MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />NOVEMBER 20, 1984 <br />Present: President James Boehmer, Councilmen Bierman, O~Grady, Petrigac, <br />Rademaker, Saringer, Tallon, Wilamosky. <br />Also present: Mayor Robert Swietyniowski, Law Director Michael Gareau, Finance <br />Director Edward Boyle, Clerk of Council Florence Campbell. <br />Meeting was called to order by President Boehmer at 8:00 P.M. <br />Members of the audience were invited to join Members of Council in reciting the <br />Pledge of Allegiance. <br />Minutes of Regular Council Meeting of November 7, 1984, were approved. <br />Minutes of Special .Council Meeting of November 13, 1984, were approved. <br />Mayor Swietyniowski reported: 1) Expressed condolences to John Muller, Engineering <br />Department, on the death of. his wife, Fran. <br />2) With respect to the Flagner property on Porter Road, the contractor has been <br />cited by the Building Department and the case is now in Rocky River Court. The <br />citation was issued for violation of Ordinance No. 74-112 which prohibits the <br />accumulation of debris and junk. Owners now have $35,000 invested in repairs <br />and restoration of the home; City is reluctant to start condemnation proceedings <br />again; additional information, as received, will be provided to Council. <br />Law Director Gareau reported: 1) The Zurawski Case, won by the City in the lower <br />court, went to the Court o.f Appeals who reversed the case and remanded it on a <br />technical basis. When the case went to Common Pleas Court originally, Law Director <br />filed a motion to dismiss under Civil Rules of_ Procedure 12B6, indicating that it <br />failed to state a cause of action. Court of. Appeals basically said that the Judge <br />should have converted that to a summary judgment action and because he did not do <br />so, they reversed it. Since there is no dispute in fact, Law Director will file a <br />motion for summary judgment and it will probably go through the same process all <br />over again. <br />2) Law Director is currently in the second day of the Cooper Trial, the Civil Rights <br />Case; perhaps will finish Monday. <br />Finance Director Boyle reported: 1) The State of Ohio will be conducting an audit in <br />the near future, using an independent auditing firm as opposed to the state examiners. <br />Audit will probably start late in December or early in January. <br />2) Was informed by Regional Income Tax that the City has now passed its 2.6 million <br />dollars in collections, which it had budgeted for 1984. Prior to next Council <br />Meeting, will have a more concrete figure to be used for the transfer and appropriation <br />legislation that will be coming up next month. <br />Mrs. Saringer, Chairman Intra-Governmental Relations and Legislation Committee re- <br />ported: 1) Committee met this evening, prior to caucus, to interview Mr. Robert <br />Gomersall, the Mayor's appointment to serve on the Zoning Board of Appeals. Committee <br />has no objection; Mrs. Saringer moved Council approve the appointment of Mr. Robert <br />Gomersall to the Board of Zoning Appeals, for the term ending December 31, 1987, <br />replacing Mr. Lou Horvath, second by Tor. Tallon, unanimously approved. <br />
