MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />MARCH 20, 1984 <br />Present: President James Boehmer, Councilmen Bierman, O'Grady, Petrigac, <br />Rademaker, Saringer, Tallon, Wilamosky. <br />Also present: Mayor Robert Swietyniowski, Law Director Michael Gareau, <br />Finance Director Edward Boyle, Safety Director Eugene Petre, <br />Clerk of Council Florence Campbell. <br />Meeting was called to order by President Boehmer at 8:00 P.M. <br />Members of the audience were invited to join Members of Council in reciting the <br />Pledge of Allegiance. <br />Minutes of Council Meeting of March 6 1984, were approved. <br />President Boehmer announced that seven pieces of legislation were to be added to <br />tonight's agenda. Ordinance No. 83-96, amending Section 165.03 of the Codified <br />Ordinances entitled "Landmarks Commission; Creation, Composition and Terms"; <br />Resolutions No. 84-22, 84-23, 84-24 and 84-25 which authorize the Service Directar <br />to advertise for bids for concrete, highway paint, stone and asphalt; Resolutions <br />No. 84-26 and 84-27 which commend the public service of Councilmen Woerpel and McKay. <br />Finance Director Boyle reported: 1) House Bill 291, passed last year, grants a <br />$10,000 exemption on assessed value of personal property tax beginning in 1984. <br />Personal property tax is paid mostly on equipment and inventory, usually twice <br />during a year, the end of April and on September ZOth. Assumes the first distri- <br />bution, from the April 30th pay, would be the lowest and would hit hardest. Has <br />received a letter from County Auditor, Tim McCormack, attempting to estimate what <br />this will do to the City budget. It will probably cost the City approximately <br />$28,000 in June. State will reimburse the City 82Y in 1984 and hopefully 100% <br />every year thereafter but this will not occur until December or January. City <br />may have a $28,000 short-fall in personal property taxes; more likely, no less <br />than $5,000, the 18% difference between 82% and 100%. This will cause a slight <br />cash flow shortage through December at least, <br />2) City received $44,000 today in auto registrations and $67,000 in local govern- <br />ment. Local government was a little off last year because of some poor distributions <br />for the prior year. City is back on schedule and this is a normal distribution. <br />Law Director Gareau reported: 1) Tomorrow morning, a pre-trial has been scheduled <br />in the Great Northern versus City of North Olmsted Case, even though the City has <br />not received service of summons regarding the case. <br />2) Is preparing a motion to dismiss the King's Path/City of North Olmsted appeal. <br />The court had ruled that the City was required to help abate what they considered <br />to b e a private nuisance; City appealed from that because it has no authority to <br />assist in abating a private nuisance. King's Path did not file a cross appeal but <br />did file another appeal some thirty/forty days later. You cannot have two appeals <br />from a final, appealable order. City's appeal was timely; King's Path appeal was <br />an untimely appeal; Law Director will move to dismiss that appeal. <br />f~;: <br />
