~ i <br />MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />DECEMBER 5, 1989 <br />Present: President Janet Saringer, Councilwoman Bahas, Councilmen <br />Boehmer, Bohlmann, McKay, O'Grady, Tallon, Wilamosky. <br />Also present: Mayor Yvonne Petrigac, Law Director Michael Gateau, Finance <br />Director Edward Boyle, Clerk of Council Florence Campbell. <br />Meeting was called to order by President Saringer at 8:00 P.M., in Council <br />Chambers, 5200 Dover Center Road, North Olmsted. <br />Minutes of Council Meeting of November 21, 1989, were approved. <br />President Saringer announced: 1) Ordinance Nos. 89-102 and 89-103 have been <br />added to this evening's agenda. <br />2) Suspension of the rule requiring three readings will be requested on Ordin- <br />ance Nos. 89-97, 89-98, 89-100, 89-101 and 89-102. <br />Mayor Petrigac reported: 1) With respect to Councilman Wilamosky's inquiry at <br />the last council meeting, has advised that the signalization of the thirty-two <br />intersections is 45' completed and the 1480 Interchange is 907 completed. <br />2) Letter has been sent to County Engineer Neff suggesting that Canterbury and <br />Gessner Roads be placed on the county's Operational Resurfacing Program for 1990. <br />3) Letter was received from the Environmental Board of Review postponing the <br />stay hearing until January 25, 1990, at 11 A.M. <br />4) Has signed a contract with United Survey to rehabilitate all catch basins in <br />the Deerfield Area. This will seal and repair existing damanged catch basins <br />and insure the efficiency of the Hydro-brakes. Project should be completed by <br />year's end. <br />5) Christmas tree ornaments and decoration of the council chambers was done by <br />Pack 52, Little Tiger Boy Scout Pack. <br />Law Director Gateau reported: 1) In the past week, there has been a great deal <br />of activity with respect to the Law Department's efforts, along with Squire, <br />Sanders and Dempsey, on the EPA Sewer Tap-in Ban Case. Basically, this case <br />was fought on two fronts: one in Federal Court dealing with the subject, <br />"should a temporary restraining order be issed by the Federal Court", which <br />Judge Alice Batchelder opted to continue until next Thursday when the Environ- <br />mental Board of Review is to hear the request for a stay and two, dealing with <br />the taking of depositions, on Monday, by the Law Department, with respect to the <br />EPA official who was responsible for having recommended that. the ban be in- <br />stituted, and on Tuesday, the taking of depositions from Service Director Noble <br />and Plant Superintendent Crider. No hearing was held on Thursday because a call <br />was received from the Attorney General's office suggesting that they agreed to <br />the stay and on January 25th, if a number of issues presently in dispute are not <br />resolved, a hearing would be held to determine whether or not the stay should <br />continue until such differences were resolved. <br />2) There was also some activity with respect to the Clark Oil Case. A variance <br />had been requested for a canopy; Board of Zoning Appeals turned it down; the <br />Court of Common Pleas overturned the Board of Zoning Appeals and the issue is <br />now in the Court of Appeals. <br />
