f <br />MINUTES OF THE MEETING OF THE COUNCIL <br />}~ OF THE CITY OF NORTH OLMSTED <br />APRIL 2,1996 <br />Present: Council President Boehmer, Council Members Limpert, Lind, McKay, <br />Musial, Nashar, Saringer <br />Also Present: Mayor Boyle, Law Director Gareau, Finance Director Burns, Clerk of <br />Council Semen <br />Absent: Council Member O'Grady <br />Council President Boehmer called the meeting to order at 8 p.m. in Council Chambers, <br />5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in reciting the Pledge of Allegiance <br />to the Flag. <br />The minutes of the meeting of March 20, 1996 were approved as written. <br />REPORTS <br />Mayor Boyle: 1) The annual telephone book recycling program will take place from <br />April 27 through June 30. The closest drop-off centers to North Olmsted are the <br />Cleveland Metroparks Zoo, Huntington Reservation picnic area and the Rocky River <br />Nature Center. <br />2) On May 4, the City of Solon will be selling a plastic backyard composting unit for $35. <br />Hours of the sale are 8 a.m. to 2 p.m. <br />3) The Police Department is back up to full strength with the recent swearing in of Officer <br />Bill Saringer who is currently attending the police academy. <br />Law Director Gareau: 1) Last week the city was granted a summary judgment on the <br />basis of governmental immunity in the long-standing Chester vs. Brand case. This case <br />involved people who were seen removing articles from the Goodwill. A neighbor turned <br />in the license plate number to the police and the individuals were arrested. Unfortunately, <br />when it came time to testify in court, the neighbor could not be found. The case was <br />dismissed and the city was sued for $250,000. Since this case was handled by insurance <br />counsel and there was a $10,000 deductible at that time, the city will have to pay that <br />amount for the defense costs. <br />2) The Fox case has been appealed to the Court of Appeals. <br />3} An age discrimination case has been filed against the city through the Ohio Civil Rights <br />Commission. The case has been brought by a 51 year old individual who was not allowed <br />to take the firefighter examination because the city has a 35 year age cutoff. <br />
