MINUTES OF THE MEETING OF THE COUNCIL <br />~~ <br />OF THE CITY OF NORTH OLMSTED <br />OCTOBER 20, 1998 <br />Present: President Pro Tem Limpert, Council Members Gareau, Kasler, McKay, <br />Miller, Nashar, O'Grady <br />Also Present: Mayor Musial, Law Director Gareau, Finance Director Copfer, Clerk of <br />Council Seman <br />Absent: Council President Saringer <br />Council President Pro Tem Limpert called the meeting to order at 8 p.m. in Council <br />Chambers, 5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in reciting the Pledge of Allegiance <br />to the Flag. <br />The minutes of the Council meeting of October 6, 1998 were approved as written <br />President Pro Tem Limpert announced that the next Council meeting would be held on <br />Wednesday, November 4, because of Election Day. <br />Mr. McKay moved that Council amend the agenda to include Ordinance No. 98-121 on <br />first reading. The motion was seconded by Mr. O'Grady and unanimously approved. <br />REPORTS <br />Mayor Musial: 1) The Ward 3 Town Hall meeting will be held on Thursday, October 22, <br />from 7:30 p.m. to 9 p.m. at Spruce School. <br />2) He delivered the "State of the City" address to the Chamber of Commerce on <br />Thursday, October 15. A copy of the presentation will be given to Council members. <br />Law Director Gareau: 1) The federal lawsuit with respect to the jail inmate who <br />committed suicide has been moved to a federal court. (Insurance counsel is handling this <br />litigation.) When a lawsuit is moved to a federal court and qualified immunity is <br />requested, the State of Ohio requires that all discovery is suspended until the issue of <br />qualified immunity is determined. That then can be appealed directly to the Sixth Circuit <br />before going through a whole host of discovery proceedings. <br />2) Documents and answers to interrogatories that were submitted regarding the Chamber <br />of Commerce case have been received. <br />3) The Supreme Court, ruling in the Fattlar case, has interpreted the Charter in an <br />interesting fashion. They have ruled that the Mayor has authority under certain <br />circumstances to discharge division heads and the directors also have the right to <br /> <br />
