'~ <br />CITY OF NORTH OI,MSTED <br />ORDINANCE N0. 80- 93 <br />BY: <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO <br />THE ELECTORS OF THE CITY OF NORTH OLMSTED OF <br />CERTAIN AMENDMENTS TO THE CHARTER OF THE CITY <br />OF NORTH OLMSTED AS RECOMMENDED BY THE CHARTER <br />REVIEW COMMISSION, AND DECLARING AN EMERGENCY. <br />WHEREAS, the Charter Review Commission of the City of North <br />Olmsted, appointed pursuant to Article XIV of the Charter of the <br />City of North Olmsted, has filed its report of recommended admend- <br />ments to the Charter with this Council. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF-THE CITY <br />OF NORTH OLMSTED COUNTY OF CUYAHOGA, AND STATE OF OHIO, TWO-THIRDS <br />OF ALL MEMBERS CbNCURRING: <br />SECTION I: That this Council hereby authorizes and directs <br />the submission to the electors of the City of North Olmsted at an <br />election to be held at the usual places of voting in said City <br />on Tuesday, November 4, 1980, the following separate proposals to <br />amend the Charter of the City of North Olmsted: <br />Pro osal 1: That Article IV, Section 12 of the Charter <br />relating to t e effective date of ordinances and resolutions be <br />further restricted to prohibit the Council from adopting an ordinance <br />or resolution the subject of which is the expenditure of money for <br />capital improvements for the purchase of public lands for the expendi- <br />ture for construct-ion of public buildings, under an emergency measure <br />or under suspension of rules, such amended Section 12 of Article IV <br />to read as follows: <br />ARTICLE IV <br />THE COUNCIL <br />SEC. 12. EFFECTIVE DATE OF ORDINANCES AND RESOLUTIONS. <br />Each ordinance or resolution providing for the appropriation <br />of money or for an annual tax levy, or for improvements petitioned <br />for by the owners of a majority of the front footage of property to <br />be benefited or specially assessed therefor and any emergency ordinance <br />or resolution necessary for the immediate preservation of the public <br />peace, health, safety or welfare of the City, shall take effect, <br />unless a later date be therein specified, upon its approval by the <br />Mayor, or upon the expiration of the time within which it may be <br />vetoed by the Mayor, as the case may be. No other ordinance or <br />resolution shall become effective until after the expiration of <br />thirty (30~ days following its approval by the Mayor or at the expira- <br />tion of the time within which it may be vetoed by the Mayor or upon <br />its passage after veto by the Mayor, as the case may be. Each emer- <br />gency measure shall contain a statement of the necessity for such <br />emergency action and shall require the affirmative vote of two-thirds <br />of the members of Council eligible to vote for its enactment.. No <br />action of Council authorizing the surrender or joint exercise of any of <br />its powers, or in granting any franchise, or rezoning ordinance, or <br />amendment or repeal of any zoning ordinance or section thereof, or <br />expenditure for capital improvements or expenditure for the purchase <br />of public lands or grounds or expenditure for construction of public <br />buildings shall be designated an emergency measure nor enacted under <br />a suspension of the rules adopted by Council. <br />
