f <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 80-~_ <br />Ar ~ u~ <br />AN ORDINANCE ESTABLISHING WORKING CONDITIONS <br />AND BENEFITS TO BE PAID TO THE EMPLOYEES <br />OF THE NORTH OLMSTED MUNICIPAL BUS LINE, <br />AND DECLARING AN EMERGENCY. <br />WHEREAS,Council and the Administration wish to update the <br />benefits for the employees of the North Olmsted Municipal Bus Line <br />in order that they be similiar to benefits presently offered to the <br />employees of the Greater Cleveland Regional Transit Authority. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: Work Week-Overtime <br />A. The normal work week for regular full time employees <br />of the North Olmsted Municipal Bus Line shall be forty (40) hours. <br />Said work week shall commence at 12:01 A.M. Sunday through 12:00 <br />Midnight Saturday. It is recognized that the bus line shall be <br />maintained on a schedule compatible with efficient and practical <br />transit service seven (7) days a week. Therefore, it is further <br />recognized that the North Olmsted Municipal Bus Line retains the <br />right to manage and direct the work force as well as the right to <br />determine the manner and method of assigning work. It is further <br />recognized that some employees may be assigned to work schedules <br />to accommodate seven (7) day per week service which may of necessity <br />involve overtime work. Hourly employees will be paid at time and <br />one-half of the straight time rate for all hours in excess of eight <br />(8) hours per day, and also, time and one-half of their straight <br />time rate for all hours worked in excess of forty (40) hours in <br />any one work week. Time and one-half shall not be paid more than <br />once for the same working time (spread penalty excepted), and any <br />work paid at time and one-half shall not be included in hours upon <br />which weekly overtime is computed. It should also be noted that <br />the North Olmsted Municipal Bus Line shall determine the manner <br />and method of assigning and offering all overtime work which is <br />consistent with efficient transit practices. <br />B. When a bus driver is assigned work on his scheduled <br />day off it is understood that time will be paid at the time and <br />one-half rate with the exception of charter work. The time worked <br />in charter service will be paid on a straight time rate and will <br />not be used in computing overtime pay. <br />C. With respect to non-bus driving personnel, in the <br />computation of weekly overtime, recognized holidays shall be consider- <br />ed as time worked to the extent of the normal regular hours called <br />for, except where the holiday coincides with the scheduled day off <br />of the employee. <br />D. All salaried employees may be paid overtime upon <br />recommendation of department heads and approval of the appointing <br />authority, at the time and one-half hourly rate, provided, however, <br />that in no such instance shall daily and weekly overtime be duplicated. <br />All such salaried employees who work in excess of the <br />applicable and appropriate basic work week hours shall be paid for <br />such time worked at his or her time and one-half hourly rate in <br />addition to his or her salary, provided that such overtime is <br />authorized by the employee.°s supervisor. <br />
