<br />.,., <br />y <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 80- 40 <br />BY: %~. <br />-aIWN <br />AN ORDINANCE AMENDING SECTION 351.18 OF CHAPTER <br />351 OF THE CODIFIED ORDINANCES OF THE CITY OF <br />NORTH OLMSTED, ENTITLED "PARKING GENERALLY" AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Council of the City of North Olmsted has reviewed <br />the waiver provisions and has determined that the fees are presently <br />inadequate. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That Section 351.18 of the Codified Ordinances <br />of the city o North Olmsted entitled "Waiver Provisions" now <br />reading as follows: <br />"351.18 WAIVER PROVISIONS. <br />(a) Whoever violates any provision of this Chapter shall <br />be guilty of a misdemeanor. Any such person who has received <br />notice to appear and to answer to such violation, upon filing <br />personally with the Chief of Police at the City Hall, a written <br />plea of guilty, commonly known as a waiver, within forty-eight <br />hours after such notification, Sundays or holidays excepted, may <br />for such offense pay a fine of six dollars ($6.00) without costs. <br />If such. written plea is made after forty eight (48) hours after <br />such notification, Sunday or holidays excepted, then such violator <br />may pay a fine of Ten Dollars ($10.00), without costs. <br />(b) Notwithstanding other waiver fees contained herein, <br />any violator of Section 351.13 or 351.14 may sign a waiver and pay for <br />the first offense, Fifteen Dollars ($15.00), and for each subsequent <br />offense during the same winter season, not less than Twenty-five <br />Dollars ($25.00) . <br />(c) Upon failure of a violator to appear and make such <br />pleas as aforesaid within a seventy-two (72) hour period, a warrant <br />may be issued for the arrest of the violator and, upon conviction <br />of the offense, such violator shall be subject to the penalty provided <br />in Section 303.99 of this Traffic Code and all provisions incorporated <br />herein." <br />~e and the same is hereby amended and as amended shall read as <br />follows: <br />"351.18 WAIVER PROVISIONS. <br />(a) Whoever violates any provision of this Chapter shall be <br />guilty of a misdemeanor. Any such person who has received notice to <br />appear and to answer to such violation, upon filing personally with <br />the Chief of Police at the City Hall, a written plea of guilty, <br />commonly known as a waiver, within forty-eight (48) hours after <br />such. notification, Sunday or holidays excepted, may for such offense <br />pay a fine of Seven Dollars ($7.00) without costs. If such written <br />plea is made after forty-eight (48) hours after such notification, <br />Sundays or holidays excepted, then such violator may pay a fine of <br />Twelve Dollars ($12.00) without costs. <br />
