? <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 98-11 <br />BY: COUNCILMAN MICHAEL GAREAU, JR <br />k? <br />AN ORDINANCE CREA.TING NEW SECTION 1367.11 OF THE BUILDING CODE IN <br />ORDER TO FXF',MPT SAIALL SATELLITE DISH ANTENNAE FROM THE PERMIT FEE <br />REQUIh'EMENTS OF CHAPTER 1367, AND DECLARING ANEMERGENCY. <br />WHEREAS, the federal Telecommunications Act of 1996 limits the authority of municipal <br />corporations to charge permit fees for the installation of certain direct broadcast satellite dishes <br />(DBS), TV antennae, and antennae used to receive multichannel multipoint distribution (wireless <br />cable) programming (NIlVIDS); and <br />WHEREA.S, it is the desire of this Council to enact a new Section 1367.11 of Chapter 1367 <br />of the Building Code, which regulates satellite dish receiving stations located on residential and <br />commercial property in the City of North Olmsted, so as to exempt the installation, erection, and <br />maintenance of the aforementioned types of antennae from the permit application and fee <br />requirements of said Chapter 1367; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTIONI: That there be and hereby is created new Section 1367.11 of Chapter 1367 of <br />the Building Code, entitled "Satellite Dish Receiving Stations," which new Section shall be entitled <br />and shall read as follows: <br />1367.11 No Permit or Fee Required for Certain Types of Satellite Dish Antennae. <br />The permit application and permit fee requirements of this Chapter sha11 not apply to the <br />installation, erection and/or maintenance of any of the following types of satellite dish and other <br />antennae: <br />1. Satellite dish antennae which are one meter (39") or less in diameter and are designed <br />to receive direct broadcast satellite service, including direct-to-home satellite service; <br />2. Satellite dish antennae or other antennae which aze one meter (39") or less in diameter <br />or diagonal measurement and are designed to receive video programming services via MMDS <br />(wireless cable). Such antennas may be mounted on "masts" to reach the height needed to <br />establish line-of-sight contact with the transmitter. However, where a mast higher than twelve <br />(12) feet is desired or required, installation, erection and maintenance of such antennae shall be <br />subject to the permit application and permit fee requirements of this and any other relevant <br />Chapter of the Codified Ordinances. <br />
