, -- <br />w.. <br />?. <br />I ? <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 9 0 -118 <br />BY: THE ENTIRE COUNCIL <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE ELEC- <br />TORS OF THE CITY OF NORTH OLMSTED, OHIO OF AN AMENDMENT <br />TO ARTICLE IV, SECTION 3(D) OF THE CHARTER PROVIDING <br />FOR THE FILLING OF A VACANCY IN SAID OFFICE FOR THE <br />UNEXPIRED TERM AS A RESULT OF SAID VACANCY AS RECOM- <br />MENDED BY THE CHARTER REVIEW COMMISSION AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, the Charter Review Commission of the Citp of North Olmsted, <br />appointed pursuant to Article XIV of the Charter of the City of North <br />Olmsted, has filed its report of recommended amendments to the Charter with <br />this Council, and <br />WHEREAS, this Council deems it appropriate to submit the within pro- <br />posal to the electors for their consideration at the General Election to be <br />held within the City on November 6, 1990. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO, TWO-THIRDS OF ALL MIIMBERS <br />CONCURRING: <br />SECTION 1: That this Council hereby authorizes and directs the sub- <br />mission to the electors of the Citp of North Olmsted at the General Elec- <br />tion to be held at the usual places of voting in said City on Tuesday, <br />November 6, 1990, the following separate proposal to amend the Charter of <br />the City of North Olmsted: <br />Proposal: That Article IV Section 3(d) of the Charter relating to the <br />filling of a vacancy in the office of President of Council for the unex- <br />pired term be amended to provide that whenever the office of President of <br />Council becomes vacant, the vacancy shall be filled by appointment of a <br />majority vote of Council for the unexpired term or until the election of a <br />successor if the vacancy occurs more than.two qears prior to the expiration <br />of the unexpired term and the vacancy also has occurred more than seventy <br />five (75) days prior to the primary election. Such proposed Amended Sec- <br />tion 3(d) of Article IV shall read as follows: <br />Artile IV <br />The Council <br />SECTION 3. PRESIDENT OF COUNCIL. <br />(d). Vacancy in Office. Whenever the office of President <br />of Council becomes vacant, the vacancy shall be filled by appoint- <br />ment by majority vote of the members of Council eligible to vote, <br />to serve for the unexpired term or until the election of a succes- <br />1
