L <br />` <br />A RESOLUTION AUTHORIZING AND DIRECTING THE MAYOR AND <br />DIRECTOR OF LAW TO ACCEPT ON BEHALF OF THE CITY OF <br />NORTH OLMSTED THE VACANT APARTMENT BUILDING CONTAINING <br />SIX (6) SUITES WHICH IS CURRENTLY LOCATED ON PROPERTY <br />OWNED BY PARADISE PONTIAC, AND TO FURTHER NEGOTIATE AND <br />PRESENT TO THIS COUNCIL A FINAL PROPOSAL FOR THE MOVING <br />OF SAID APARTMENT BUILDING TO THE SOUTHEASTERLY PORTION <br />OF THE RECREATION CENTER PROPERTY; TO PRESENT A LEASE <br />AGREEMENT WITH EITHER THE WEST SHORE COUNCIL OF GOVERN- <br />MENTS OR THE WEST SHORE FNFORCIIMEAiT BUREAU FOR THE <br />OPERATION OF A REHABILITATION/DETENTION FACILITY TO BE <br />UTILIZED BY SAID ENTITY FOR DRIVING WHILE UNDER THE <br />INFLUENCE OF ALCOHOL OFFENSES; TO PRESENT TO THE COUN- <br />CIL AN OPERATING AGREIIKENT WITH ORIANA HOUSE, A NON- <br />PROFIT ORGANIZATION, TO OPERATE SAID FACILITY; AND TO <br />PRESENT TO THIS COUNCIL ANY ADDITIONAL ASPECTS IN ORDER <br />TO FACILITATE THE USE OF THE AFORESAID BUILDING FOR <br />ALCOHOL REHABILITATION AND DETENTION, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, the Director of Law has, without officially being sanctioned <br />to do so, unofficially has been negotiating with the owners of Paradise <br />Pontiac, situated in the City of North Olmsted, for the donation of a six- <br />suite apartment building with the understanding that the same will be moved <br />to City-owned property immediately to the West of said property; and <br />WHEREAS, this Council recognizes that, with the stricter enforcement <br />of driving while under the influence violations, comes the necessity for <br />providing space to incarcerate said individuals; and <br />WHEREAS, with the recent adoption of tougher standards by the State of <br />Ohio, the Ohio Legislature has recognized the desire to establish less <br />stringent standards for incarcerating offenders of the driving while under <br />the influence statute; and <br />WHEREAS, one of the provisions of the most recently adopted amendments <br />to the driving while under the influence statute is the permissible use for <br />detention of public buildings that normally would not be considered to be <br />high security facilities; and <br />WHEREAS, this Council deems it desirable to use the aforesaid apart- <br />ment building because of the fact that the facility can be utilized by the <br />West Shore communities and at the same time the cost of moving and renovat- <br />ing said building is a fraction of the cost for new construction.
