<br />CITY OF NORTH OLMSTED <br />ORDIAIANCE N0. 90- 64 <br />gy: RONALD TALLON <br />? <br />AN ORDINANCE LEVYING SPECIAL ASSESSMENTS FOR THE <br />IMPROVEMENT OF NORTH OLMSTED INDUSTRIAL PARKWAY BETWEEN <br />CERTAIN TERMINI BY GRADING, DRAINING, CURBING, PAVING AND <br />CONSTRUCTING A WATF.R A9AIN AND STORM AND SANITARY SEWERS, <br />TOGETHER WITH THE NECESSARY APPIIRTENANCES THERETO, AND <br />DECLARING AN EMERGENCY <br />W}IEREAS, the improvement described in Section 1 has been completed <br />and tlie final cost of that improvement has been determined; <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, Cuyahoga County, Ohio, that: <br />Section 1. The special assessments for the cost and expense of <br />improving in the City North 0lmsted Industrial Parkway from Lorain Road <br />southeasterly approximatery 556 feet, thence easterly approximaCely 1699 feet <br />to its terminus by grading, draining, curbing, paving and constructing a water <br />main and storm sewers; by constructing sanitary sewers in that Parkway and in <br />easements of the Ci.ty fifteen feet w.ide running parallel with and contiguous <br />t:c, each side of that Parkway; and by constructing a water main in an easement <br />of tlie City thirty feet wide running from a point in that Parkway <br />approximatel.y 945 feet from the centerline of Lorain Road southerly <br />approximately 465 feet, thence easterly approximately 384 feet to an existing <br />water main; in each case together with the necessary appurtenances thereto, <br />pursuant to Resolution No. 88-68 adopted June 21, 1988, amounting in the <br />aggr.egate to $1,010,000, which were filed and are on file with the Clerk of <br />Council, are adopted and confirmed. Those special assessments are levied and <br />assessed upon the lots and lands provided for in Resolution No. 88-68 in tYie <br />respective amounts set forth in the schedule of special assessments on file, <br />which special assessments are in proportion to the special benefits and are <br />not in excess of any statutory limitation. <br />Section 2. This Council finds and determines t.hat the special <br />assessments a.re in the satne proportion to the estimated special assessments as <br />the actual cost of the improvement is i;o the estimated cost of the improvement <br />as originally filed. <br />Section 3. The special assessment against each lot or parcel of land <br />sha:ll be payable in cash within 30 days after the passage of this ordinance, <br />or at the option of the owner in twenty annual instaliments with interest at <br />the same r.ate as borne by the bonds to be issued in anticipation of the <br />collecLion of the speclal assessments.
