•? . <br />C <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 90- 54 <br />BY: PAT BAHAS <br />? <br />?...y <br />, ??? <br />? <br />AN ORDINANCE AMENDING CHAPTER 713 OF THE BUSINESS <br />REGULATIONS CODE OF THE CODIFIED ORDINANCES OF THE <br />CITY OF NORTH OLMSTED ENTITLED "STRUCTURES FOR NON- <br />TRANSIENTS" BY ADDING THERETO A NEW SECTION 713.19 <br />ENTITLED "OCCUPANCY RESTRICTIONS" AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, it has come to the attention of this Council that unless <br />there are some restrictions with respect to the number of individuals who <br />may occupy a multiple family dwelling unit, that the dwelling units within <br />the City may become overcrowded, thus impacting upon the health, safety and <br />welfare of not only the residents of the dwelling units, but also the <br />health, safety and welfare of the residents of the Citp as a whole, and <br />WHEREAS, it is deemed appropriate to control the adverse use and <br />overcrowding of dwelling units within the Citq to place restrictions on the <br />number of square foot area that would be required to be set aside in each <br />dwelling unit as space for sleeping area. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH <br />OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />Section 1. That there is hereby created a new Section within the <br />Business Regulation Code within Chapter 713 which new Section shall be <br />designated 713.19 entitled "Occupancy Restrictions" and shall read as <br />follows: <br />713.19 OCCUPANCY RESTRICTIONS. It shall be the responsibility of the <br />owner or the designated manager of every multi-family dwelling complex to <br />determine prior to the letting of a dwelling unit within said complex, the <br />number of individuals occupying said dwelliing unit. In every instance the <br />owner or manager of said multi-family dwelling complex, shall establish the <br />number of square foot area within said unit which is designated as sleeping <br />area. The number of persons being permitted to occupy said dwelling unit <br />shall be restricted in accordance with the following standard as it relates <br />to the available square foot area of sleeping space within said dwelling <br />unit. There is hereby established a minimum of 70 square foot of sleeping <br />area for the first occupant of the dwelling unit, and 50 square foot of <br />sleeping area for each additional person.
