? <br />. ? <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 92-I03 <br />By: Councilwoman Janet Saringer <br />? <br />.----? <br />, <br />q 7 <br />AN ORDINANCE CREATING CHAPTER 556 OF THE <br />GENERAL OFFENSES CODE OF THE CITY OF NORTH <br />OLMSTED, ENTITLED "LIGHTING NUISANCE CONTROL, " <br />AND DECLARING AN EMERGENCY. <br />WHEREAS, former Councilman Ronald Talon, while on this Council, conducted <br />extensive research and reviewed various model code provisions relating to the control of <br />commercial exterior lighting and its impact upon adjacent residential property; and <br />WHEREAS, this Council, having had the benefit of former Councilman Ronald Talon's <br />research and review, and his conclusions therefrom, desires to enact legislation to regulate <br />commercial exterior lighting upon residential properties in the City of North Olmsted, by <br />prohibiting lighting nuisances upon residential property and imposing criminal penalties for <br />violations; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHID: <br />Section 1: That there be and hereby is created Chapter 556 of the General Offenses <br />Code, entitlerl "Lighting Nuisance Control," which, as created, shall read in its entirety as <br />follows: <br />"CHAPTER 556 <br />Lighting Nuisance Control <br />556.01 LEGISLATIVE FINDINGS AND INTENT; RESPONSIBILITIES OF <br />PROPERTY OWNERS. <br />(a) This Council hereby finds that exterior lighting, when improperly designed, <br />installed, and/or maintained, can create nuisance conditions upon neighboring properties, <br />particularly upon residential neighbors. Such nuisance conditions typically manifest themselves <br />unreasonable light trespass, glare and irritating movement. Accordingly, it is the intent of this <br />Council that the following provisions of this Chapter be construed to penalize conduct which is <br />likely to cause nuisance conditions to be visited upon neighbors and which unreasonably <br />interferes with the neighbor's peaceful enjoyment of his property. <br />(b) Parking and circulation areas, pedestrian areas and related outdoor use areas <br />shall be illuminated to provide safety and security for the users of these areas, to provide
