<br />~ ~~~ <br />~1 ORDINANCE AMFNDTNGE SECTIOF 1 OF ORDINANCE N©. 2,504 <br />ENACTED BY THE CITY OF FORTE ~LMSTED OF JIILY 15, 1957, <br />~sTABZISBINa a FFw IOCFSS P~ZN2 TO BR008PARg ROAD (S$ 17) <br />IN THE CITY OF FORTH OL1KS3`ED, AT A PpI1~ APPR4YIMATELY <br />1818 FEET T4 1863 FEET EASTEBI,Y OF THE IFTERS~SIOF OF <br />BRO08PARH 80AD AND LORAII~ ROA19 (S~ 1D) IF THS CITY OF <br />NO&!'H OL~i$'PED, FOR THS PERP4SES OF JFFOBDtNB BETTS'R <br />CONTBOb OF TRAFFIC IN AND TO THE SHOPPIFC CBE'PER LOCATED <br />SOtTTH OF THE INTERSECTION OF SR 10 AND S8 17, A1'PH <br />DECLARINf~ AN E1KER(~EENCY. <br />WHLREAS~ the Council of the City of North Olmsted has heretofore by <br />Ordinance Fo. 1979, passed IKaJ 5, 1954, consented to the iaprovement of <br />Breokpark Road (SR 17) according to the plans Filed with the City by the ,State <br />Director of Hig~waya,, reflecting Brookpark Road within the corporate limits of <br />the City of Forth Olmsted as a limited access highway and indicating thsr.vn <br />points of access to said Thoroughfare, and <br />WHEFtEAS~ other conditions are contained in said Ordinance of Coaseat <br />a:td the obligation of the City for the maintenanee of said Thoroughfare when <br />completed, and <br />WHEREASs at a point Southerly from the intersection of Brookpark Road <br />and Lorain Road (SR lO), a ahoppimg center with parking area has been erected <br />according to pleas submitted to the City of North Olmsted which have bssn <br />approved, and <br />WHEREAS, the sine of the shopping center and its location has caused <br />the Council to give considerable study to the resulting traffic control problem <br />which will be created and its direct relation to the traffic problem that will <br />exist on Brookpark Road sad on Lorain Road, and <br />WHEREAS, the developer of the shopping center has cooperated with the <br />City of North Qlmated, in an endeavor to plaa~ the development in a manner to <br />bring about the most effective and simplest prep®aal for the control of traffic <br />sad from said shopping center from the aforesaid highways, and <br />WHEREAS, the developer has retained the H. K. Ferguson Company, <br />Engineers, to assist in planning the aatraaces to and from the shopping center <br />for the Host effective traffic control peaaible is relation to Brookpark <br />Road (SR 17) and Lorain Road (SR lO), and <br />WHEREAS, after a study of the proposed plans submitted by the develops <br />the Council of the City of North plmsted had determined the most affective <br />traffic control possible indicated the logic of locating as access point to <br />Broe]cpark Road to be approzimately 150p feet to 1563 feet Easterly of the <br />intersection of Brookpark Road and Lorain Road (SFt 11J)~ and <br />WHEREAS, the shopping center having been almost completely constructed <br />the developer and tenants of said center have determined it to be more feasible <br />for access to and from Brookpark 8oad to said shopping center parking area to <br />relocate the access point to Brookpark Road approximated 318 feet Easterly of <br />the present proposed access point or approximated 1818 teat to 1863 feet <br />Easterly of the intersection of Brookpark Road (SR 1?) and Lorain Road (SR 10), <br />and <br />WHEREAS, The City has been advised that the Department of Highways of <br />the State of Ohio has given tentative approval of the relocation of said access <br />point if the City of forth Olmsted approves said relocation of said access point <br />NOW, THEREFORE, BE IT ORDAINED By the Council of the City of North <br />Olmsted, Ohio, two-thirds of all members elected thereto concurring: <br />That Section 1 of Ordinance No. 2504, enacted by the City of North <br />Olmsted, July 15: 1957, reading as follows: <br />~,. <br />_, <br />ORDINAFCE F0. -~ <br />.. p <br />
