CITY OF NURTH OLMSTED RESOLUTION No. 62`~_ ~y %~ ~ ~~ A RESi7LUTIJN DECLARIi~fG THE ivECESSTTY (:)F CONSTRUCTING SIDEWALKS IiV FRONT OF THE LOTS AND LANDS ABUTTING ON BC?TH SIDES OF FLEHARTY AVEiVtJE FROi~ BRKPARz~~ ROAD TO LORAIi~i ROAD, AND DECLARING AN ENN~EERGENCY. WHEREAS, Council has determined that the construction of sidewalks on both sides of Fleharty Avenue from Brookpark Road to Lorain Road is necessary for the safety, wel- fare and protection of the public; and WHEREAS, the Engineer of this City ha.s prepared plans, specifications, estimates and profiles of said proposed improvement. NOW, TH~aREFORE, ~3E IT RESOLVED by the Council of the Citv of North Olmsted, State of Ohio: Section 1: That it is necessary and conducive to the public convenience, safety and welfare to construct a five foot concrete sidewalk upon both sides of Fleharty Avenue in f rant of the lots and lands abutting thereon between Brookpark Road and Lorain Road. Section 2: That the plans and specific~.tions of said improvement heretofore prepared by the Engineer of this City are now on file in the office of the Director of Public Service and the estimates of cost of said improvement heretofore pre- pared by the Engineer of this City are now on file in the office of the Clerk of Council, and said plans and specifications and said estimates of cost be and the same are hereby approved. Section 3: That such sidewalks shall be constructed pursuant to and in accordance with said plans and specifications on file in the off ice of the Director of Public Service at the North Olmsted City Hall, Dover Center Road, between Lorain Road and Butternut Ridge Road, North Olmsted, Ohio. Section 4: That such sidewalks shall be constructed by the owners of all lots and lands abutting on Fleharty Avenue between Brookpark Road and Lorain Road in accordance with such specifications not later than thirty C30) days from the date of service of notice of the passage of this Resolution. Section 5: That the Clerk of this Council be and she is directed to cause a written notice to be served as required by law notifying the owners of all lots and lands abutting on Fleharty Avenue of the following: (a) The passage of this Resolution. (b) The fact that plans and specifications are on file as set forth above. (c) The time during which such owners may con- struct their sidewalks in accordance with the plans and. specifications. (d) The fact that any sidewalks not so constructed within the time permitted will be constructed by the City and assessed against said abutting lot owners.
