w <br />, <br />".' <br />? <br />BY: ' <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 71- ? <br />A1V ORDINANCE AMENDING SECTION 3 AND <br />SECTION 5 OF ORDINANCE IVO. 69-56, EN- <br />ACTED RPRIL 1, 1969, AND ENTITLED " AN <br />ORDINANCE ESTABLSIHING RATES TO BE <br />CHARGED FOR THE SERVICES OF THE MUNICI- <br />PAL SANITARY SEWERAGE SYSTEM UTILITY OF <br />THE CITY OF NORTH OLMSTED ", AND DE- <br />CLARING AN EMERGENCY. <br />? WHEREAS, Council of the City of IVorth Olmsted has heretofore determined <br />to construct, and the City is now in process of constructing, a sewerage system and <br />sewage treatment works and has deterrnined to operate the same, together with all <br />additions thereto hereafter made ar acquired by the City ( hereinafter generally called <br />the " System as a public utility ; and <br />WHEREAS, by Ordinance IVo. 2867 Council established certain rates and <br />charges for the service provided by the System and has now determined and found'it <br />necessary to.revise such rates so as to assure sewer revenues at least sufficient to <br />meet the cost of operating and maintaining the System, and also, debt charge,5, reserve <br />and other requirements of its mortgage revenue bonds heretofore authorized and sold <br />for thepurpose of financing part of the cost of constructing the System, for which <br />purpose tYiis Ordinance shall supersede Ordinance No. 67-185, Ordinance No. 61-15 6, <br />Ordinance No. 61"1110, Ordinance No. 3159, and Sections 3 and 5 of Ordinance No. <br />69-5 6. <br />WHEREAS, to facilitate the proper billing and collection of such charges <br />with respect to properties now or hereafter served by the waterworks system of the <br />City of Cleveland, Council proposes to authorize the Cleveland Water Department <br />to handle such billing along with its billing of water supplied by it ; and <br />WHEREAS, the Water Pollution Control Board has directed the City of North <br />Olmsted to construct additional waste treatment facilities by reason of higher water <br />quality standards established by the State of Ohio and the United States of America <br />for the Lake Erie Drainage Basin necessitating higher degree of treatment ( tertiary ) <br />and removal of phosphates ; and ' <br />WHEREAS, to finance these additional waste treatment facilities the City <br />of North Olmsted ha s determined it to be nece s sary to revi se the rate s charged for <br />the services of Municipal Sewerage System Utility. <br />NOW, THEREFORE, BE IT ORDAINED by the Council of the City of North <br />Olmsted, State of Ohio : <br />Section 1. That Section 3 of Ordinance No. 69-5 6, enacted April 1, 19 69 , <br />now reading as follows: <br />Section 3. " That for the purpose provided in Section 2 hereof, there is <br />hereby levied and charged upon each lot, parcel of land or premises having or required <br />to have a connection with the System, or otherwise discharging sewage, industrial <br />wastes, water or other liquids, either directly ordndirectly into the System, <br />. ?...
