J r CITY OF NORTFi OLMSTED 0 BE IT RESOLVED by the Council of the City of North Olmsted, Cuyahoga County, Ohio: Section l. That it is necessary to improve Palm Drive from the end of the existing pavement easterly approximately 375 feet to the westerly terminus of Birch La.ne by grading, draining, curbing, paving and constructing storm and sanitary sewers, sewer curb connections and sidewalks, together with the necessary appurtenances. Section 2. That said street shall be improved as shown on the plans hereinafter referred to and now on file in the office of the Clerk of this Council. Section 3. It is hereby determined and declared that said improve- ment is conducive to the public health, convenienee and welfare of said City and the inhabitants thereof. Council flzrther finds and determines that said improvement has been petitioned for by the owner of all of the property to be assessed for said improvement. Section 4. That the grade of said street and improvement sha11 be the grade as shown by the plans and profiles which have been prepared by Richard A. Labas & Associates, Consulting Engineers, and which are made a part hereof. Section 5. That the plans, specifications, estimates and profiles of the proposed improvement, heretofore prepared by Richard A. Labas & Associates, Consulting Engineers, and now on file in the office of the Clerk of this Council, are hereby approved. _ Section 6. That the whole cost of said improvement sha11 be assessed in proportion to the benefits which may result from the improvement upon Lots 1 to 5, inclusive, of Birch Iane Subdivision and'the property abutting upon the north side of Pa1m Drive between the termini of the improvement, which 5aid lots and lands are hereby determined to be specially benefited by said improvement; and the cost of said improvement shall include the cost of preliminaxy and other surveys, plans, specifications, profiles and estimates and of printing, serving and publishing notices, resolutions and ordinances, the amount of damages re- sul.ting from the improvement assessed in favor of any owner of land affected by the improvement and the interest thereon, the costs incurred in connection with the preparation, levy and collection of the special assessments, the cost of pur- chasing, appropriating, and otherwise acquiring therefor any required real estate or interests therein; expenses of legal services including obtaining an approving legal opinion, cost of labor and material and interest on bonds and note issued in anticipation of the levy and collection of the special assessments together with all other necessaxy expenditures. ?c ^RESOLUTION NO.?
