LOGAN <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION TO <br />THE ELECTORS OF THE CITY OF NORTH OLP!LSTED OF <br />PROPOSED AMENUN1ENTS TO THE CEIAItTER OF THE <br />CITY OF NORTH OL.MSTED RELATING TO THE ELECTION <br />OF SUCCESSORS IN THE F.VENT QF VACANCIES IN THE <br />OFFICE OF MAYOR, DIRECTOR OF LA?N, DIRECTOR OF <br />FINANCE AND COUNCIL, AIVD DECLARING AN 0-1ERGENCY. <br />WHEREAS, pursuant to the Charter of the City and the Constitution of <br />the State of Ohio, this Cowlcil has determined to authorize and direct the <br />submission to the electors of the City of North Olmsted of the proposed <br />Charter Amendments hereinafter set forth, at the General Election to be held <br />on November 7, 1978, which election is not less than sixty (60) nor more than <br />One Hundred 'Itiventy (120) days from the date of passage of this Ordinance; <br />NOW, 'IHEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NOR'IH <br />OI,T4.STED, CLJYAHOGA COUN'IY, OHIO, TWO-THIRDS OF ALL MENIBERS CONCURRING: <br />SECTION l: That this Council hereby authorizes and directs the submission <br />to the electors of the City of North Olmsted at the General Election to be held <br />at the usua.l places of voting in said City on Tuesday, November 7, 1978, the <br />following proposals to amend the Charter of the City of North Olmsted: <br />(A) That Section 4 of Article III of the Charter to be amended to provi <br />for the election o a successor to t e o ice oy our in t e event t e o ice <br />of N1a. or becomes vacant more than two years rior to the expiration of the <br />une ire term anmore t n seventy ive ys nrior to t e te .or the <br />primary election, such amen ed_Section 4 of Article III to rea as ollows: <br />SEC. 4. VACANCY IN THE OFFICE OF MAYOR <br />(a) Absence. When the r7a.yor is absent or inaccessible or is unable for <br />any cause or reason to perform his duties, the President of Council shall become <br />the acting Ma.yor, but he shall not thereby cease to be President of Council. <br />(b) Vacancy. In the event the o£fice of Mayor shall become wacant for <br />any reason, tTie President of CoLmcil shall thereupon become the Mayor, and <br />serve for the unexpired term or until the beginning of the term o.f a successor <br />duly elected as hereinafter provided, and his office as President of CoLmcil <br />shall become vacant. <br />(c) Absence of President of Coimcil. In the event the President of Council <br />shall be absent or inaccessible or for any reason wlable to perform his duties <br />as acting Ma.yor, then CoLmcil, by a vote of a majority, shall designate one of <br />their number to act as Ma.yor. <br />(d) Election of Successor in the Event of Vacancy. In the event the office <br />of Mayor shall ecome vacant, a successor or the unexpired term shall be elected <br />as Ma.yor at the next regular municinal election, provided that (a) such election <br />shall occur more than two (2) years prior to the expiration of the Lm.expired term <br />and (b), the vacancy shall have occurred more than seventy five (75) days prior <br />to the date for primary election. A President of Council or a councilman, who <br />has become Mayor pursuant to suhsections (b) and (c) of this Section, may be a <br />candidate to succeed himself. <br />(B) That Section 5 of Article IV of the Charter to be amended to provide <br />for the election o a successor to t e o ice of CoLmcilman in the event the otfice <br />of Councilman becomes vacant more than two Z years prior to the expiration of
