LOGAN AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE ELECTORS OF THE CITY OF NORTH OLP!LSTED OF PROPOSED AMENUN1ENTS TO THE CEIAItTER OF THE CITY OF NORTH OL.MSTED RELATING TO THE ELECTION OF SUCCESSORS IN THE F.VENT QF VACANCIES IN THE OFFICE OF MAYOR, DIRECTOR OF LA?N, DIRECTOR OF FINANCE AND COUNCIL, AIVD DECLARING AN 0-1ERGENCY. WHEREAS, pursuant to the Charter of the City and the Constitution of the State of Ohio, this Cowlcil has determined to authorize and direct the submission to the electors of the City of North Olmsted of the proposed Charter Amendments hereinafter set forth, at the General Election to be held on November 7, 1978, which election is not less than sixty (60) nor more than One Hundred 'Itiventy (120) days from the date of passage of this Ordinance; NOW, 'IHEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NOR'IH OI,T4.STED, CLJYAHOGA COUN'IY, OHIO, TWO-THIRDS OF ALL MENIBERS CONCURRING: SECTION l: That this Council hereby authorizes and directs the submission to the electors of the City of North Olmsted at the General Election to be held at the usua.l places of voting in said City on Tuesday, November 7, 1978, the following proposals to amend the Charter of the City of North Olmsted: (A) That Section 4 of Article III of the Charter to be amended to provi for the election o a successor to t e o ice oy our in t e event t e o ice of N1a. or becomes vacant more than two years rior to the expiration of the une ire term anmore t n seventy ive ys nrior to t e te .or the primary election, such amen ed_Section 4 of Article III to rea as ollows: SEC. 4. VACANCY IN THE OFFICE OF MAYOR (a) Absence. When the r7a.yor is absent or inaccessible or is unable for any cause or reason to perform his duties, the President of Council shall become the acting Ma.yor, but he shall not thereby cease to be President of Council. (b) Vacancy. In the event the o£fice of Mayor shall become wacant for any reason, tTie President of CoLmcil shall thereupon become the Mayor, and serve for the unexpired term or until the beginning of the term o.f a successor duly elected as hereinafter provided, and his office as President of CoLmcil shall become vacant. (c) Absence of President of Coimcil. In the event the President of Council shall be absent or inaccessible or for any reason wlable to perform his duties as acting Ma.yor, then CoLmcil, by a vote of a majority, shall designate one of their number to act as Ma.yor. (d) Election of Successor in the Event of Vacancy. In the event the office of Mayor shall ecome vacant, a successor or the unexpired term shall be elected as Ma.yor at the next regular municinal election, provided that (a) such election shall occur more than two (2) years prior to the expiration of the Lm.expired term and (b), the vacancy shall have occurred more than seventy five (75) days prior to the date for primary election. A President of Council or a councilman, who has become Mayor pursuant to suhsections (b) and (c) of this Section, may be a candidate to succeed himself. (B) That Section 5 of Article IV of the Charter to be amended to provide for the election o a successor to t e o ice of CoLmcilman in the event the otfice of Councilman becomes vacant more than two Z years prior to the expiration of
