r . s.,?,..>. .,-?.... , ?... ? .a?. CITY OF NORTH OLMSTED ORDINANCE N0. 78- 83 BY: AN ORDINANCE ACCEPTING AN EASEMENT FROM RICHARD P. KADAR AND ROBERT H. BARTEL D.B.A. VIENNA CONSTRUCTION COMPANY FOR STORM SEWERS LOCATED IN THE VIENNA WOODS SUBDIVISION N0. lA WITHIN THE CITY OF NORTH OLMSTED. WHEREAS, a storm sewer has been incorporated within the design and construction of the Vienna Woods Subdivision No. lA, and WHEREAS, the City Engineer has advised the Council that it is in the best interest of the City of North Olmsted to accept an easement with respect to the storm drainage system, and , WHEREAS, it is the desire of the City of North Olmsted and said Richard P. Kadar and Robert H. Bartel d.b.a. Vienna Construction Company, to have the City's rights in said storm drainage system clearly specified and made a matter of record by recording a formal easement, and WHEREAS, this Council deems it to be in the best interest of the City of North Olmsted to accept said Easement. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That this Council does hereby accept an easement from Richard P. Kadar and Robert H. Bartel d.b.a. Vienna Construction Company for the construction and maintenance of a storm drainage system under and on the property described in said Easement which is attached hereto and marked Exhibit "A", and made a part hereof as though fully rewritten herein. SECTION 2: That the Engineer of the City of North Olmsted is hereby directed to cause said Easement to be recorded in the Office of the Recorder of Cuyahoga County. SECTION 3: That this Ordinance shall take effect and be in force from and after the earliest period allowed by law. PASSED: ? ATTEST: NORA T.
