CITY OF NORTH OLMSTED ORDINANCE NO. 2015 - 47 BY: Mayor Kennedy AN ORDINANCE PROVIDING FOR THE SUBMISSION OF AN N AMENDMENT TO THE ELECTORS OF THE CITY OFNORTH OLMSTED TO ARTICLE VII,SECTION 2 OF THE CHARTER OF THE CITY OFNORTH OLMSTED TO ENTIREL YREPEAL SECTION 2(e) OF ARTICLE VII AND CREATE A NEW AND REVISED SECTION 2(e) OF ARTICLE VII, REQUIRING ALL ORDINANCES PROPOSING TO ZONE OR REZONEA PARCEL OF LAND TO MULTIPLE RESIDENCE(APARTMENT) ONLY BE VOTED UPON AND APPROVED BY THE ELECTORS OF THE CITY OF NORTH OLMSTED, AND DECLARING AN EMERGENCY. WHEREAS,the City Charter currently requires a submission to the Electors of any proposed zoning or rezoning to multifamily when the number of dwelling units in multifamily dwellings exceeds twenty percent(20%) of the total of all dwelling units in the Municipality; and WHEREAS,multifamily dwellings currently exceed twenty percent(20%)of the total of all dwelling units in the Municipality; and WHEREAS,the Director of Planning and Development believes that sound planning policy requires the referral to the electors of proposals for zoning or rezoning of Multiple Residence (Apartment) only; and WHEREAS, it is the desire of this Council to submit to the voters of North Olmsted a proposal to amend Article VII, Section 2(e)of the Charter of the City of North Olmsted by repealing section 2(e)and replacing the same with a new and revised section 2(e)requiring elector approval for zoning or rezoning to Multiple Residence (Apartment) only; and WHEREAS, this proposal was reviewed and recommended by the Charter Review Commission in accordance with Article XIV,Section(b)(1)of the City Charter,and the Commission on the 6th day of May, 2015, filed a written report with the Clerk of Council in which the Commission stated that, by a 7 to 0 vote, a motion to recommend approval of the proposal passed; and WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner than 120 days,and no later than 60 days,prior to the date of the election at which the issue will be voted upon by the electorate.
