CITY OF NORTH OLMSTED <br /> ORDINANCE NO. 2015 - 47 <br /> BY: Mayor Kennedy <br /> AN ORDINANCE PROVIDING FOR THE SUBMISSION OF AN <br /> N <br /> AMENDMENT TO THE ELECTORS OF THE CITY OFNORTH <br /> OLMSTED TO ARTICLE VII,SECTION 2 OF THE CHARTER <br /> OF THE CITY OFNORTH OLMSTED TO ENTIREL YREPEAL <br /> SECTION 2(e) OF ARTICLE VII AND CREATE A NEW AND <br /> REVISED SECTION 2(e) OF ARTICLE VII, REQUIRING ALL <br /> ORDINANCES PROPOSING TO ZONE OR REZONEA PARCEL <br /> OF LAND TO MULTIPLE RESIDENCE(APARTMENT) ONLY <br /> BE VOTED UPON AND APPROVED BY THE ELECTORS OF <br /> THE CITY OF NORTH OLMSTED, AND DECLARING AN <br /> EMERGENCY. <br /> WHEREAS,the City Charter currently requires a submission to the Electors of any proposed <br /> zoning or rezoning to multifamily when the number of dwelling units in multifamily dwellings <br /> exceeds twenty percent(20%) of the total of all dwelling units in the Municipality; and <br /> WHEREAS,multifamily dwellings currently exceed twenty percent(20%)of the total of all <br /> dwelling units in the Municipality; and <br /> WHEREAS,the Director of Planning and Development believes that sound planning policy <br /> requires the referral to the electors of proposals for zoning or rezoning of Multiple Residence <br /> (Apartment) only; and <br /> WHEREAS, it is the desire of this Council to submit to the voters of North Olmsted a <br /> proposal to amend Article VII, Section 2(e)of the Charter of the City of North Olmsted by repealing <br /> section 2(e)and replacing the same with a new and revised section 2(e)requiring elector approval for <br /> zoning or rezoning to Multiple Residence (Apartment) only; and <br /> WHEREAS, this proposal was reviewed and recommended by the Charter Review <br /> Commission in accordance with Article XIV,Section(b)(1)of the City Charter,and the Commission <br /> on the 6th day of May, 2015, filed a written report with the Clerk of Council in which the <br /> Commission stated that, by a 7 to 0 vote, a motion to recommend approval of the proposal passed; <br /> and <br /> WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner <br /> than 120 days,and no later than 60 days,prior to the date of the election at which the issue will be <br /> voted upon by the electorate. <br />
