MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />APRIL 4, 2017 <br />Present: Council President Jones, Council Members Brossard, Hemann, Kearney, <br />Limpert, Rahm, Schumann & Williamson <br />Also Present: Mayor Kennedy, Director of Finance Copfer, Director of Human <br />Resources Gallo, Director of Law Gareau, Director of Safety & Service <br />Glauner, Clerk of Council Massarolo, and Director of Planning & <br />Development Wenger <br />Council President Jones called the meeting to order at 8:00 p.m. in Council Chambers, <br />5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in the recitation of the Pledge of <br />Allegiance. <br />The Special Council meeting minutes of March 15, 2017 were approved as written. <br />The Council meeting minutes of March 21, 2017 were approved as written. <br />REPORTS <br />Mayor Kennedy: <br />• The City Offices will close at Noon on Friday, April 14 in honor of Good Friday. <br />• The Eggstravaganza is Saturday, April 15 from 10 to Noon. <br />• The Fish Fry's are going really well. The MS Society made nearly $1,500.00 in <br />tips and the Bretton Ridge Women's Club made almost $1,300.00 in tips. <br />• Sponsorships are continuing to come in for the 2017 Boom. <br />• The Recreation Center wanted to report March revenue numbers are looking <br />good. We are currently $36,000 ahead of last year at this time. <br />Director of Law Gareau: <br />• A resident has communicated with me about Ordinance 2017-32, our Zoning <br />Code Amendment. The question was raised if having the map and the actual <br />amendment to the Code in the same piece of legislation was in violation of the <br />Charter restriction on one subject. In Ohio, legislation is only supposed to deal <br />with one topic. I looked at the issue, I do not believe it to be a concern. The <br />Supreme Court of Ohio has reviewed this issue. The new Zoning Code is applied <br />to a certain number of parcels. They are intertwined. The Court has taken the <br />position of giving a great amount of latitude to the legislator. It is designed to <br />prevent log rolling, when you take 25 different topics and give it one title and <br />people do not even know what they are voting on. When the Court described it, <br />they said it needs to be a manifestly gross and fraudulent violation of the one <br />subject provision. As long as a common purpose or relationship exists between <br />the topics then there will not be a disunity in subject matter rather than an <br />aggregation of topics which will cause the bill to violate one subject.
