MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />MAY 16, 2017 <br />Present: Council President Jones, Council Members Brossard, Hemann, Kearney, <br />Limpert, Rahm, Schumann & Williamson <br />Also Present: Mayor Kennedy, Director of Human Resources Gallo, Director of Law <br />Gareau, Clerk of Council Massarolo, and Director of Planning & <br />Development Wenger <br />Absent: Director of Finance Copfer, Director of Safety & Service Glauner <br />Council President Jones called the meeting to order at 8:00 p.m. in Council Chambers, <br />5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in the recitation of the Pledge of <br />Allegiance. <br />The Council meeting minutes of May 2, 2017 were approved as written. <br />The following legislation will be considered for passage under suspension of the rules <br />this evening: Second Reading — Ordinance 2017-38; First Reading — Resolution 2017- <br />39. <br />REPORTS <br />Mayor Kennedy: <br />• Announced the scholarship recipients for 2017. These scholarships are funded <br />from those who run the race in North Olmsted and also sponsorships. This year <br />the race will take place on June 17 at North Olmsted Park. We have been giving <br />these scholarships away for a number of years now. It won't go too far towards <br />paying your college bills, but every little bit helps. The list of award winners and <br />their bios are attached to the minutes. <br />Director of Law Gareau: <br />• A couple quick updates on cases that have been discussed in the past. The first is <br />the City of North Olmsted v. Westbury Holdings, which is aligned with City of <br />North Olmsted v. Niederst Management Ltd. This is the Westbury, which I've <br />reported in the past the apartments have had a number of maintenance issues with <br />the exterior facilities. As a result, they were charged and brought to court. They <br />have entered into a Plea Diversion Program which sets forth specific timelines for <br />achieving maintenance items regarding the exterior of the building. It's going to <br />require some time. They have been working with the Building Department to get <br />the permits in and get proper individuals on board to do the work as it's very <br />significant. By entering the diversion program, if they meet the target <br />requirements the charges will be dismissed at a later date. If they don't, however, <br />
