The oath is attached to the minutes.
Director of Law Gareau:
• The last time there was a major flooding event in North Olmsted in addition to
residential losses there was a significant issue of damage and loss to the
Wastewater Treatment Plant and some upgrades taking place there at the time of
the flooding. We have had issues with the contractors and who was going to pay
for it. For the past three years, the City has said no we are not going to pay for it
as we did nothing wrong. The City is hopefully getting close to a resolution in this
issue with the contractors and my hope is the City will not end up paying for it.
We are still owing on some of the contract money. They just want to get the rest
of their money due under the contract and go on their way.
• In the matter of Theresa Sullivan v. Regina Opheim. This was a lawsuit filed
against the City and its prosecutor. It was filed exclusively based on his duties as
a prosecutor. There are at least three sections in the common law which state why
he is immune from litigation. There has been a motion filed and a hearing
scheduled for tomorrow where the City can hopefully also get this behind it as
well.
