CITY OF NORTH OLMSTED <br />ORDINANCE N0. 82-169 <br />BY: <br />AN ORDINANCE AUTHORIZING THE MAYOR TO ENTER <br />INTO A SECOND SUPPLEMENTAL AGREEMENT BETWEEN <br />THE CITY OF NORTH OLMSTED AND THE CUYAHOGA <br />COUNTY COMMISSIONERS FOR OLMSTED TOWNSHIP <br />SEWER RATES, AND DECLARING AN EMERGENCY. <br />WHEREAS, on April 15, 1965 and May 23, 1974, the City and the <br />County entered into Agreements providing for the City to accept, receive, <br />transport and dispose of sanitary sewage and waste originating in an <br />area of Olpisted Township, and <br />WHEREAS, the increased costs of operation and maintenance of the <br />North OlMSted Wastewater Treatment Plant have been allocated to the <br />various entities being served by the City's treatment facilities, and <br />the allocation to the County for the area served reauires that rates <br />and charges be increased, and <br />IVHEREAS, the Cuyahoga County Commissioners, the Mayor and the Council <br />of the City of North Olmsted have agreed on the rates as set forth in <br />Exhibit "A" attached hereto. <br />NOjV, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLNISTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That the Mayor of the City of North Olmsted is hereby <br />authorize3 to enter into a contract with the Cuyahoga County Commissioners, <br />said contract being known as the Second Supplemental Agreement to the <br />contract entered into on April 15, 1965 and N1ay 23, 1974, and to do <br />everything necessary to put in force the conditions of the Second <br />Supplemental Agreement which is attached hereto. <br />SECTION 2: That this Ordinance is hereby declared to be an emergency <br />measure necessary for the immediate preservation of the public health, <br />safety and welfare, and for the further reason that it is immediately <br />necessary in order that the City of North Olmsted not subsidize for the <br />sewage treatment of users in Olmsted Township, and further provided it <br />receives an affirmative vote of two-thirds of all members elected to <br />Council, it shall take effect and be in force immediately upon its passage <br />and approval by the Mayor. <br />PASSED: ? .1/0 /9f.2- <br />r <br />ATTEST: <br />Ok k eno" <br />/lorence E.
