CITY OF NORTH OLPISTED ORDINANCE N0. 82 - 135 BY : 2&.e. /??1. AN ORDINANCE AUTHORIZING THE MAYOR OF THE CITY OF NORTH OLMSTED TO ENTER INTO AN AGREEMENT WITH THE CITY OF FAIRVIEW PARK WHEREBY THE CITY OF NORTH OLMSTED WILL ACCEPT AND TREAT ALL WASTEWATER FROP4 THE "PARKVIEW" SERVICE AREA OF THE CITY OF FAIRVIEW PARK AND WHEREBY THE CITY OF FAIRVIEW PARK AGREES TO PAY THE SAME WASTE- WATER TREATMENT RATE AS IS ESTABLISHED FOR NORTH OLMSTED USERS. WHEREAS, the City of North Olmsted has completed a Step 1 Facility Plan and is nearing completion of Step 2 for wastewater collection and treatment in the North Olmsted Facility Planning Area, and WHEREAS, sections of incorporated areas in the Cit,y of Fairview Park are tributary to and served by the municipal sewer systems in the City of North Olmsted, and WHEREAS, the United States Environmental Protection Agency has mandated that all users of the Wastewater Treatment Facility pay a fair and equitable user charge. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby directed to enter into an agreement with the City of Fairview Park whereby the City of North Olmsted will accept and treat all wastewater from the "Parkview" Service Area of the City of Fairview Park and whereby the residents of the Service Area will pay the same wastewater treatment rate as is established for North Olmsted users in accordance with the agreement which is attached hereto and marked Exhibit "A" and made a part hereof as though fully rewritten herein.
