WOERPEL <br />AN ORDINANCE AMENDING THE ZONING CODE OF THE CITY <br />OF NORTH OLMSTED BY AMENDING SECTION 1174.10 <br />ENTITLED "REGULATIONS REGARDING THE INSTALLATION <br />OF OUTDOOR TELEPHONE PAY STATIONS" OF CHAPTER 1174 <br />ENTITLED "HEIGHT AND AREA REGULATIONS FOR RETAIL <br />BUSINESS DISTRICTS", AS AMENDED. <br />WHEREAS, Council has determined that adequate telephone <br />communications are needed for emergency situations and safety <br />considerations, and <br />WHEREAS, Council desires to insure the safe and proper installa- <br />tion of pay telephone stations, as well as the maintenance of same. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION l: That the Zoning Code of the City of North Olmsted <br />be amende by revising Section 1174.10 entitled "Regulations Regard- <br />ing the Installation of Outdoor Telephone Pay Stations" of Chapter <br />1174 entitled "Height and Area Regulations for Retail Business <br />Districts", which Section presently reads as follows: <br />"1174.10 REGULATIONS REGARDING THE INSTALLATION <br />OF OUTDOOR TELEPHONE PAY STATIONS. <br />For the purposes of this Zoning Code the installation of <br />pay telephones shall be considered to be a permitted use by virtue <br />of 1173.02 (d)(3) of the Zoning Code, and the following shall con- <br />stitute the regulations for the installation of pay phones within <br />the City of North Olmsted: <br />(a) No pay phone support structure shall be permitted within <br />the first twenty-five (25) feet of the setback nor shall any pay <br />phone structure be permitted to be constructed closer than five <br />feet (51) from the side yard of any lot. <br />(b) There shall be required for each telephone located in <br />the phone support structure a minimum of two (2) parking spaces <br />per telephone. <br />(c) No free standing pay phone structure nor any pay phone <br />structure attached to an existing building shall be installed until <br />such time as the applicant has filed the proper application for a <br />building permit, together with a signed and notarized document from <br />the property owner that the applicant has permission to install the <br />aforesaid telephone structure." <br />be and the same is hereby amended, and as amended, shall read as <br />follows: <br />1174.10 REGULATIONS AND GUIDELINES REGARDING THE <br />INSTALLATION AND MAINTENANCE OF OUTDOOR <br />TELEPHONE PAY STATIONS. <br />For the purposes of this Zoning Code, the installation of <br />outdoor telephone pay stations shall be considered to be a permitted <br />use by virtue of Section 1173.02 (d)(3) of the Zoning Code, and the <br />following shall constitute the regulations, procedures, and guidelines <br />for the installation of such telephones within the City.
