, CITY OF NORTH OLMSTED ORDINANCE N0. 82- 90 BY: MAYOR SWIETYNIOWSKI 41(X- - I I I I g I AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR OF THE CITY OF NORTH OLMSTED TQ ENTER INTO AN AGREEMENT WITH CERTAIN PROPERTY OWNERS FOR THE REINiBURSENIENT OF PRELIMINARY ENGINEERING AND OTHER COSTS ASSOCIATED WITH THE IMPROVEMENT OF A PUBLIC STREET, AND DECLARING AN EMERGENCY. WHEREAS, certain property owners have, by their Petition dated as of April 23, 1982, (the "Petition"), reQuested this Council to open a public street, running southerly from Lorain Road, thence easterly to a cul-de-sac terminus, in the area between Lorain Road and Interstate 480 immediately to the east of the westerly corpora- tion line of the City, and for the improvement of said street by grading, draining, curbing, paving and installing a water main, storm and sanitary sewers, together with the necessary appurtenances thereto, and to assess the entire cost thereof in proportion to the benefits which may result therefrom upon the lots and lands bounding and abutting said street, all subject to certain conditions set forth in the Petition, and WHEREAS, the City will incur certain preliminary planning, engineering and iegal expenses prior to receiving bids for the construction of the improvements to said proposed public street, and WHEREAS, the property owners have reserved the right to cancel and withdraw from their obligations contemplated by the Petition if the construction bid for such improvements exceeds by fifteen percent (150) or more the estimated assessments for the improvements, and WHEREAS, the petitioning property owners have agreed to reimburse the City for all of its said preliminary planning, engineering and legal expenses, should the property owners cancel and withdraw from the obligations they agreed to or assumed in the Petition. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AIVD STATE OF OHIp: SECTION l: That the Mayor be and he is hereby authorized and directec.?to enter into an agreement between the City of North Olmsted, Ohio, and the following property owners; Property Owners Permanent Parcel Nos.
