<br />MINUTES OF THE HOUSING, PLANNING, & DEVELOPMENT COMMITTEE <br />JUNE 12, 2023 <br />AUDITORIUM <br /> <br />Present: Councilmembers Bullock (Chair), Kepple and Shachner <br /> <br />Also Present: Councilmembers Marx and Baker, Law Director Vargo, Chief of Staff Storey <br /> <br />Call to Order: 6:05 p.m. <br /> <br />Approval of the minutes of the May 22, 2023 Housing, Planning & Development Committee <br />meeting. <br /> <br />A motion was made and seconded to approve the minutes of the May 22, 2023 Housing, Planning & <br />Development Committee meeting. All members voted in favor. Motion passed. Minutes approved. <br /> <br />SUBSTITUTE ORDINANCE 10-2023 - AN ORDINANCE to take effect January 1, 2024 to <br />establish new Chapter 781, Automobile Business Operations, of the Lakewood Codified <br />Ordinances to establish regulations for automobile related businesses within the City of Lakewood. <br />st <br />(1 read & referred to HPD 5/1/23) <br />Chair Bullock introduced the amended version of Substitute Ordinance 10-2023. <br />Law Director Vargo went over the recent changes to the ordinance. He mentioned the <br />clarification of language regarding the definition of an operator and the inspection that will take <br />place. Director Vargo requested the committee to recommend the substituted version to the Full <br />Council. <br /> <br />Chair Bullock and Law Director Vargo went over the change regarding the narrow purpose of <br />the request for information. The purpose of the change was described to be as focused and non- <br />intrusive as possible. <br /> <br />Councilmember Baker mentioned the progress of the legislation as coordination took place with <br />Council and industry members. He asked about potential objectionable provisions by industry <br />members. <br /> <br />Law Director Vargo explained that the majority of the industry members fully support the <br />current version of the ordinance. He made mention of the opposing view regarding the utilization <br />of street parking by operators. <br /> <br />Chair Bullock and Law Director Vargo went over the process of waiting for a permit before <br />operations begin. Law Director Vargo mentioned that in the case of a suspended permit, the <br />business may continue operation before there is a final resolution of suspension. <br /> <br />Councilmember Kepple asked how the automobile businesses will be notified if the ordinance is <br />passed. Chief Storey responded that most operators are aware of the potential ordinance but will <br />be notified if it does pass. A letter was also mentioned as a potential means to notify automobile <br />business operators. <br />1 <br /> <br /> <br />
