RESOLUTION N0. 84-24 <br />INTRODUCED BY: Mayor Carmen and.Council <br />A RESOLUTION URGING THE UNITED <br />STATES ENVIRONMENTAL PROTECTION <br />AGENCY TO APPROVE THE 1982 REVISED <br />STATE IMPLEMENTATION PLAN FOR <br />MEETING THE OZONE STANDARDS IN THE <br />CLEVELAND URBP,N 'DEMONSTRATION AREA. <br />WHEREAS, in June, 1982, the Ohio Environmental Protection <br />Agency (OEPA) submitted to the United States Environmental Protection <br />Agency (USEPA) a Revised State Implementation Plan (SIP) which demon- <br />strated that the ozone standarol would be met in the Cleveland Urban <br />Demonstration Area, consisting of Cuyahoga, Lakea Lorain, and Medina <br />Counties, by December 31, 1982o the deadline prescribed by the Clean <br />Air Act; and <br />WHEREAS, the USEPA published, in the February 3, 1983 <br />Federal Register a proposed rulemaking which included approval of <br />the 1982 Revised SIP for meeting the ozone standard in the Cleveland <br />Urban Demonstration Area on the basis that attainment of said ozone <br />standard by December 31, 1982 had been demonstrated; and <br />WHEREAS, a further USEPA notice was published in the March <br />21, 1983 Federal Register extending until May 5, 1983 the comment <br />period for proposed USEPA disapproval actions first proposed on <br />February 3, 1983, but not extending time for comments on USEPA <br />proposed approval actions; and <br />WHEREAS, although the comment period for the proposed <br />approval of the Ohio Revised SIP for meeting the ozone standard in the <br />Cleveland Urban Demonstration Area expired on March 21, 1983 with no <br />negative comments receivec3 during said comment period, USEPA did not <br />subsequently issue a final rulemaking to approve the 1982 Revised SIP; <br />and <br />WHEREAS, the United States Department of Agriculture <br />published, on December 15, 1983, a notice declaring Lake and Geauga <br />Counties to be Disaster Loan Areas because of °°drought and high <br />temperatures beginning June l, 1983 and continuing thereafter'°; and <br />WHEREAS, drought and high temperatures were also experienced <br />during this period in the other counties included in the Cleveland <br />Urban Demonstration Area; and <br />WHEREP,S, the USEPA sent to the OEPA, in January, 1984, a <br />draft of a proposed rulemaking scheduled for publication in the <br />Federal Reqister during March,.1984 disapproving the 1983 Revised <br />SIP for meeting the ozone standard by December 310 1982 on the basis <br />that several violations of the ozone standard had been monitored in <br />Lake County during the summer of 1983; and
