RESOLUTION N0. 83- 7 ~ <br />INTRODUCED BY: Mayor Beebe & Council as a.Whole <br />A RESOLUTION DECLARING THE <br />NECESSITY OF IMPROVING BEECH HILL <br />ROAD BY HAVING IT. RECONSTRUCTED AND <br />PAV ED AND PROVIDING ALL <br />APPURTENANCES NECESSARY THERETO, <br />AND DECLARING AN EMERGENCY. <br />BE IT RESOLVED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. The Mayor and Council of Mayfield Village, <br />Ohio, do hereby determine it to be necessary to improve Beech Hill <br />Road between Seneca Road and Bonnieview Road by having the roadway <br />reconstructed and paved and providing all appurtenances necessary <br />thereto. <br />Section 2. The plans and specifications for the improve- <br />ment and the estimate of the cost for the improvement have been <br />prepared by the Village Engineer. The plans, specifications and <br />estimate of cost for the aforementioned improvement have been placed <br />on file in the office of the Clerk of this Council and the same are <br />hereby approved. <br />Section 3. The entire cost of the said improvement, less <br />two percent (2~) thereof and the cost of intersections, shall be <br />assessed upon the lots and lands abutting said improvement which are <br />hereby determined specially benefitted by said improvement. The <br />assessment shall be levied by the following method: In proportion to <br />the benefits which may result from the improvement; and shall be paid, <br />when levied, in semi-annual installments, with interest at the same <br />rate as is carried by the bonds to be issued in anticipation of the <br />collection thereof; provided, however, that the owner of any property <br />assessed may, at his option, pay such assessment in cash within thirty <br />(30) days after passage of the ordinance levying such assessments. <br />Section 4 Bonds of Mayfield Village, Ohio, shall be <br />issued in anticipation of the collection of the said assessments by <br />installments paid in a period not longer than twenty (20) years in an <br />amount egual thereto, and notes of the Village shall be issued in <br />anticipation of such bonds and of the levying of such assessments. <br />Section 5. The Village Engineer is hereby authorized and <br />directed to prepare an estimated assessment of the cost of said <br />improvement based on the estimate of costs heretofore filed at the <br />office of the Clerk in accordance with the method of assessments set <br />forth in this Resolution, and showing thereon the amount of the <br />assessment against each lot and parcel of land. Said estimated <br />assessment shall be filed in the office of the Clerk and shall be <br />available for public inspection. <br />
