ORDINANCE N0. 85-18 <br />INTRODUCED BY: Mayor Fred N. Carmen <br />AN ORDINANCE ESTABLISHING A POLICY OF <br />"EMPLOYER PICR-UP" OF EMPLOYEE CONTRI- <br />- BUTIONS TO THE VARIOUS OHIO PUBLIC <br />EMPLOYEES RETIREMENT SYSTEM, REPEALING <br />ALL ORDINANCES INCONSISTENT HEREWITH AND <br />DECLARING AN EMERG ENCY. <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1. Commencing with the effective date of this <br />ordinance there is hereby established a policy of "employer pick-up" <br />of employee contributions to the various Ohio Public Employees <br />Retirement System as follows: <br />(a) For the categories of Village employees listed <br />in subsection (d) hereof, the contributions required to <br />be made by each said employee to the Ohio Public Employees <br />Retirement System (PERS), the Firemen°s Pension Fund or <br />to the Police Relief Fund, as an employee contribution <br />under Ohio Revised Code Chapters 145 or 741 shall be <br />paid by the Village on behalf of the employee in lieu of <br />contribution by the employee and in accordance with the <br />provisions of this Orclinance. <br />(b) The total compensation payable by the Village to <br />each said employee in any pay period shall be reduced by <br />the amount payable by the Village to the af orementioned <br />retirement system on behalf of each said employee under <br />subsection (a) of this Section. <br />(c) The provisions of this Section shall apply to <br />all employees in the categories listed in subsection (c1) <br />hereinbelow and no such employee shall have the option <br />to receive direct payment of the amounts contributed by <br />the Village to the various. retirement systems on his or <br />her behalf instead of having them contributed to the said <br />retirement system. <br />(cl) This Ordinance shall apply to all officials and <br />employees of the municipality who elect to participate in <br />the program authorized by this Section. <br />(e) The Finance Director or his designee is hereby <br />directed to take all acts necessary and appropriate to <br />initiate implementation of the provisions of this Section, <br />including, but not limited to, making application to the <br />Internal Revenue Service for private letter rulings <br />concerning f ederal tax treatment of the provisions of this <br />plan and making applications to the appropriate state <br />retirement boards.
