1 <br />Minutes of the Special Meeting <br />November 128 1951 <br />The Council of the Village of Mayfield met-at the Tom Ha11 in <br />Special Meeting on the 12th day of November9 1951, at 8 o'clock pursuant <br />to proper noti ce duly given to all members of Council, Mayor Gustav Swanson <br />presiding. <br />Roll Ca11e Present ~ Messrs Scheuring, Taylor, Godfrey,Cass & Hall <br />Absent - Mr. Hardman. _ . <br />1 <br />i1. <br />In the absence of the Clerke Mr. Arnold D4® Edelman, the Solicitor, <br />was desi~nat®d by Council as acting Clerk for the meetin~w <br />Mr. Edelman reported fully on the situation regarding the water <br />main contracts. He .stated that although the bids 'of Curro Construction <br />Company for the improvement of Wilson Mills Road and Angelo Marra Construction <br />Company for SOM Center Road were made on August 8th, 1951, and accepted by <br />this Council on August 20th, contracts we r® not submitted to these contrac® <br />tors within the oustomary 30 day period. This was because the Village was <br />unable to obtain its commitment from the National City Bank-for the necessary <br />funds before October 31st oh which date contracts were"tendered to the <br />contractors. Also the Village of Highland Heights encountered various <br />difficulties which made it impossible for that Village to enter into any <br />contract for Wilson Mi11s Road before October 31st® As a result, Cun o <br />Construction Company wrote a letter to the Clerk of each Village, advising <br />of the withdrawal of its bids and requesting return of the checks given <br />by i t as security. .The Clerk of Mayfield Village wrote to Curro Construction <br />Company advising that the Village v~ uld insist upon a contract being entered <br />into and would retain the security check if the contractor refussd. However, <br />a meeting of the Solicitors of the two Villages tivith the Curro Construction <br />Company and its attorney has been held at which time Curro Construction <br />Company stated that it would enter into and perform the contract according <br />to its bid but that it made claim for damages caused by the unreasonable <br />delay on the part of the Village for which the contractor was in no respect <br />responsible. The contractor claimed it was damaged by reason of the <br />increase in the price of one 6" fire hydrant to the extent of X20®00 <br />and~an increase in the price of thirty-one 4" fire hydrants of.~11.00 each. <br />The contractor also stated that he feared ari..increase in freight-rates <br />on the shipment of pipes because of the long delayQ.... ••. •~; <br />fir. Edelman,and Mr. Harry Gallimore the Village Engineer, <br />recommended that the claim for damages of Curro Construction Company should <br />be allowed as being a .proper liability of the Village for the delay which <br />was caused without any fault on the part of the contractor. <br />1. <br />
