0 <br />RESOLUTION NO. 82- 10 <br />INTRODUCED BY: Council as a Whole <br />A RESOLUTION GRANTING A SPECIAL USE PERMIT <br />TO DRS. MICHAEL MATHEIS AND JEFFREY EADIE <br />FOR A PERIOD OF FOUR (4) YEARS TO USE <br />CERTAIN PREMISES FOR THE CONDUCT OF A <br />GENERAL DENTAL PRACTICE; AND DECLARING AN <br />EMERGENCY. <br />L? <br />WHEREAS, the Council of Mayfield Village, Ohio, enacted <br />Resolution 333 on May 21, 1956 granting to Dre Edwin H. Season <br />a U-6 Permit to conduct the operation of physician's and dentist°s <br />offices on the premises located at 865 SOM Center Road, Mayfield <br />Village, Ohio, which was and is zoned for single family residential <br />use; and <br />WHEREAS, Resolution 333 limited the duration of the said <br />U-6 Permit so that it would expire when Dr. Edwin H. Season <br />ceased his personal use of the subject premises; and <br />WHEREAS, Dr. Edwin H. Season ceased his personal use of the <br />subject premises on or about December 31, 1980; and <br />WHEREAS, Drs. Michael Matheis and Jeffrey Eadie became <br />tenants of the subject premises on or about January l, 1981 for <br />the purpose of conducting a general dental practice therefrom; and <br />WHEREAS, the said Drsa Matheis and Eadie were not advised by <br />Dr. Edwin H. Season that the subject premises had been granted a <br />U-6 Permit conditioned upon the fact that the said Dr. Edwin H. <br />Season continue to use the premises personally; and <br />WHEREAS, because of the lack of notice from Dr. Edwin H. <br />Season, as aforesaid, Drs. Matheis and Eadie were not aware that <br />the subject premises was not properly zoned for the conduct of a <br />general dental practice; and <br />WHEREAS, because of the lack of notice, as aforesaid, Drs. <br />Matheis and Eadie expended approximately $100,000000 in order to <br />open their own dental practice on the subject premises; and <br />WHEREAS, the municipality has, within the past several months, <br />become aware of the fact that Drs. Matheis and Eadie, and not Dr. <br />Edwin H. Season, are the current tenants of the property conducting <br />a dental practice; and „ <br />WHEREAS, the municipality has caused an investigation to be <br />made of the subject premises to determine whether or not the use <br />of the property by Drs. Matheis and Eadie has altered the use of <br />the premises from that use conducted by Dre Edwin H. Season such
