ORDINANCE N0. 85-19. <br />, <br />INTRODUCED BY: Mayor Fred N. Carmen <br />AN ORDINANCE ESTABLISHING A SEPARATE FUND TO BE <br />KNOWN AS THE "SEWER PLANNING & CONSTRUCTION FUND"; <br />AUTHORIZING AND DIRECTING THE MAYOR AND DIRECTOR <br />OF FINANCE TO MARE APPLICATION FOR TAE TRANSFER OF <br />FUNDS FROM THE CITY OF CLEVELAND TO MAYFIELD VILLAGE; <br />AUTHORIZING THE DIRECTOR OF FINANCE TO OBTAIN APPROVAL <br />FOR THE CREATION OF SAID FUND FROM THE BUREAU OF <br />INSPECTION OF THE STATE QF OHIO; AND DECLARING AN <br />EMERGENCY. <br />WAEREAS, the City of Cleveland, pursuant to a written <br />agreement, has collected funds from certain residents of Mayfield <br />Village residing on Worton Park Drive, Woodlane Drive, North and South <br />Woodlane Drives, and Norman Lane, for the purpose of the planning and <br />constructing of sanitary sewers within the municipality; anc3 <br />WHEREAS, the af orementi.oned sums were collected by the City <br />of Cleveland pursuant to an agreed sewer assessment charge levied <br />against the properties owned by the aff ected residents; and <br />WHEREAS, pursuant to the af oresaid agreement the collection <br />of the assessments ceased in mid-1982 and the fwnds have been held <br />since that time by the City of Cleveland; anc3 <br />WHEREAS, the City of Cleveland has indicatec7 a willingness <br />to assign the said funds to Mayfield Village in return for which <br />Mayfield Village would assume.all responsibility for the said funds <br />for the benefit of the affected property owners pursuant to the afore- <br />said agreement; and <br />WHEREAS, the Mayor ancl Council of Mayfield Village, Ohio <br />have determined that it is in the best interests of the municipality <br />to accept the assignment of the aforementioned funds from the City of <br />Cleveland to Mayfield Village; and <br />WHEREAS, the Mayor and Council, upon the recommendation of <br />the Director of Finance, have also determined that it is necessary to <br />create a separate funcl to be known as the "Sewer Planning and <br />Construction Fund" into which the assignment of funds from the City of <br />Cleveland will be cieposited; now, therefore <br />BE IT ORDAINED BY THE COUNCIL OF MAYFIELD VILLAGE, OHIO, THAT: <br />Section 1_ There is hereby created a fund to be known as <br />the "Sewer Planning and Construction Fund". All funds received from <br />the Gity of Cleveland and accepted by Mayfielcl Village for the purpose <br />of planning and construction of sanitary sewers for the residents <br />ref erred to in the preamble hereto shall be paid into the "Sewer <br />Planning and Construction Fund." The Director of Finance shall make <br />payment from said funds upon the presentation of vouchers or orders <br />theref ore by proper Village officials in accordance with law. Such <br />disbursement shall be made for the purpose of planning and <br />construction of sanitary sewers within Mayfield Village, Ohio.
