<br />MINUTES OF PU3LIC HEARING OF THE C0UNCiL <br />THE CITY OF IQORTH OLMSTED <br />March 23, 1970 <br />_ 8:30 p.m. <br />Present: President Francis J. 0'Neill, Coemcilmen Boehmer, Grady, <br />Prokasy, Speedling, West. <br />Also present: Maqor Ralph E. Christman, Assistant Law Director Frank <br />Lord, Service DirectoY CharZea Watts. <br />Meeting was ca3led Co order by Preeident O'Neill who stated the sole <br />pupose of thfs Public Hearing waa to discuss the pros and cans of Ordin- <br />ance No. 70--36, "An Ordinance amendi.ng the Zone Map adopted as part of <br />Ordinance Na. 62-33, (known as the ?.aning Code of the City of North Oimsted) <br />by changing the desiguatian therean of certaia land from its preaent desig- <br />aation thereon as Hf-Rise District to CQmmeretal District". <br />Ordinance No. 70-36 was read in its entirety by Counciiman John West. <br />President O'Neill asked if there was anyone in the sudience who would <br />care to address Council in favor of this Ordinance. There were no coiments. <br />At this time Mr. West stated we were notified that the Planning Commission <br />had approved the tJesterly Tawers Rescning request at their meeting of <br />December 9, 1969, and Mr. West then pointed out on a map the area under <br />discussion. <br />Mr. U'Neill asked if thexe was anycne in the audieace apposed to the <br />passage of this pfece of legislatiore who would care to comaesnt oa this <br />Ordinance. There were no comments. <br />Mr. O'Neill then asked if there was sayone -ho would caxe to coment on <br />Ord. 70-36. <br />Mr. Stanley Udelson, Partner of Westerly Towers Company, then sgoke in <br />favox of the Ordinance, also,stating he would be glad to answer any <br />questions pertaining to same. <br />Mr. tdest had Cl.erk read a letter, dated January 14, 1970, from Mr. Udelson, <br />to Mr. West, in which was stated the pla:ta if the zoning request was <br />granted; that being a ane story masonry building for a restuuraat operation. <br />Tttis will be a sit doFm, steak house operation with absviutely nv carry out <br />business of any kind, and will meet all parking requirements of the City. <br />Mr. Grady questioned in rezoaing of this type does the letter frota the <br />owner such as this become part of the granCing of Ordinance. <br />He was answered "No". Mr. tdest stated that oace it is rezosed they can <br />use it for what they want to, so all we are getting is a promi-se of what <br />is fntended. <br />
