MINUTES OF PiTBLIC HEARING <br />JUNE 5, 1972 <br />8:15 P.M. <br />Present: Councilmen Boehmer, Giesser, Limpert, Prokasy, Saringer, Speedling, <br />West. <br />Also present: Service Director Henry Caster, City Engineer Michael Karhan, <br />Clerk of Council Nora Hill. <br />Mr. West, Chairman Building, Zoning & Development Committee, called meeting <br />to order at-8:15 p.m. stating this Public Hearing is being held on Ordinance <br />No. 72-49 - An Ordinance amending the Zone Map adopted as part of Ordinance <br />No. 62-33 (known as the Zoning Code of the City of North Olmsted) by changing <br />the designation thereon as General Retail District to B Residence District. <br />Mr. Prokasy read ordinance in its entirety. <br />City Engineer Michael Karhan outlined area in question on two maps. <br />Mr. West pointed out intent of developer: first step to rezone land and <br />then to divide same into lots. It is the intent of the owner to break this <br />down into three lots which will have the same area as the present clustered <br />zoning in Bretton Ridge, and have agreed to put into deed restriction that <br />they will build the same square footage as present Bretton Ridge homes have. <br />Mr. West is in receipt of letter to that effect. Mr. West referred to the <br />triangular piece of ground which is worthless. It was suggested to the Bretton <br />Ridge Subdivision that they might want to have this for planting Bowers, etc. <br />They are not interested. This triangle will be zoned residential if ordinance <br />passes. Therefore, it cannot be used for a driveway to any commercial area; <br />so that it cannot be used to extend the parking lot of the proposed restaurant. <br />It has to remain residential and cannot be used for any other purpose. Mr. <br />Szarka will own it. Mr. Karhan stated this will be used as a drainage ditch <br />and will be used for draining the parking area. This is an open ditch. <br />Mr. Jack Dietrich, President Bretton Ridge Homeowners, said he liked the intent <br />and letter received by Mr. West regarding deed restrictions and square footage <br />to be the same, but asked what assurance does he have that this will actually <br />happen: wha~`~prvtection he would have to prevent B type square footage which <br />would be homes of less value than are presently in that area if it is zoned B <br />Residential? Mr. West explained owner cannot put deed restrictions on each <br />lot until he can subdivide. There are many steps involved. If there is a deed <br />restriction in there owner cannot build anything else. The City still has <br />control up until and including the time they ask for a permit. City does not <br />have to give owner building permit. City has a letter and the law will stand <br />behind the letter saying that, in fact, owner will build Class A type homes. <br />Mrs. D. Johnston, President Bretton Ridge Civic Association, stated the Association <br />is concerned because they maintain the entrance on both sides of Christman Drive <br />and would like some assurance that this will be maintained in the same way as the <br />rest of the residential area is maintained.
